The use of this image in the article A Cup of Kindness (play) qualifies under the "fair use" doctrine because:

  • It is a low resolution copy of publicity photograph for the show.
  • Although most (95%) of the image is used, it is too small to compete with the copyright owner's use of the image;
  • Its use will not deprive the copyright owner of income or the ability to use and exploit the image;
  • It is used for the purpose of identifying and illustrating the farcical production style of A Cup of Kindness in the context of the series of plays known as the "Aldwych farces". This image is the sole visual illustration of that production style in the article; and
  • It cannot be replaced by an equivalent free image; all three people shown are dead.
