Though subject to copyright, the image linked here is claimed to be used under fair use as:

  1. it is the cover of a single edition of a long-running, now long-defunct magazine, featuring a historically significant story by a historically significant author;
  2. it is of much lower resolution than the original (copies made from it will be of very inferior quality);
  3. its use does not infringe on the ability of the copyright holder to sell or promote the magazine or image in any way;
  4. it is being used only for informational purposes; and
  5. its inclusion in film noir adds significantly to the article because it illustrates a seminal hardboiled tale by one of the genre's most important authors, introducing the character that would evolve into Philip Marlowe, the definitive film noir private eye, as discussed in the accompanying text.
