The image is fair use because it is a historically significant photo that illustrates the main subject of the article (Bob Murphy). This picture is not replaceable by a free content image because the subject is no longer alive.

Though this image is potentially subject to copyright, its use is covered by the U.S. fair use laws because:

  1. It is a historically significant photo of a famous individual that was released in a New York Mets presser in tribute to Bob Murphy that exhibits his significance not only to the broadcasting community, but to the New York Mets franchise as a whole.
