Though this image is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

  1. It is a historically significant painting, reputed to be the best-selling image in the industry (of mass-produced Indian iconography)
  2. It is of much lower resolution than the original. Copies made from it will be of very inferior quality.
  3. The image is only being used for informational purposes.
  4. Its inclusion in the article adds significantly to the article because the photo and its historical significance are the object of discussion in the article.
  5. No free replacement exists: the original painting was made in 1934 and the artist died around 1990, so all reproductions are similarly non-free.
  6. Reproductions of this painting are widespread in India, and adding the image is crucial for it to be recognised.
