This software is copyrighted, but its screenshot is being used here in the Microsoft Search Server article under U.S. fair use laws, because:

• it helps to visually identify the software; in that sense it furthers the goal of providing verifiable information.
• it does not limit, nor does it claim to, limit the rights of the copyright holder.
• it does not, in any way, assist in illegal reproduction of the software or any other things covered by the license of the software.
• it is being used for informational purposes.
• it cannot be replaced by a free equivalent as the software itself is non-free.
• it cannot be replaced with a self-taken screenshot yet, as the product (Microsoft Search Server 2008) is not yet publicly available.
