Rationale of fair use for The New York Times Magazine[edit]

• It does not limit the copyright owner's rights to market or sell the work in any way.
• This image is used on various websites, so its use on Wikipedia does not make it significantly more accessible or visible than it already is.
• As an individual magazine cover, the image is nonreplaceable, and serves as an illustration of the NYT magazine's style and subject matter.
• The image is being used in an informative way and should not detract from the original work.
• No free or public domain images have been located.
• The alternative images were of very poor quality and failed to achieve their purpose.

It is believed that the use of low-resolution images of magazine covers to illustrate the publication of the issue of the magazine in question with the publication name either visible on the image itself or written in the image description above, on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under United States copyright law.
