Disputed fair use[edit]

Future Perfect at Sunrise is of the opinion that "a free image might reasonably be found or created" to replace this. I would ask how? Do they suggest creating one? Are they offering to loan us their time machine to do so? Even if images might "be found", the minuscule chance of this, for such an obscure and brief topic, is far beyond any "reasonable" chance. No, I am of course not of the opinion that a free image could be created as an alternative. What I am saying, however, is that the image could adequately be replaced with a description in text. The FUR says it is needed to show the kind of terrain and the nature of the soldiers' positions in it. These things can easily be covered with a textual description. So you simply reject the value of images to illustrate historically significant events?
We can of course just delete every image at WP and replace them with text. This would be possible, but I doubt if anyone else would claim it as an improvement. It is generally accepted that there is value to such an image simply because of its veracity as part of the historical event, even if it doesn't convey specific information. As the uploader, as far as I know, it may well be free usage. In my mind, it would certainly count as an "Orphan Work". The scan comes from a magazine (1952) which is now defunct. It had no (picture) correspondants of its own, nor did it use photos from other news agencies. Given that the company publishing it ceased to exist in 1988, I do feel that it is reasonable to argue that it has "Orphan Work" status. Given the nature of the photograph (during a battle), it was probably taken by a private individual anyway.
Per fair use of the image, as an historian who has done considerable research on the topic (considerable research), this is the ONLY photo of the battle which I have ever found. There is no possibility of a replacement whatsoever. --Brigade Piron (talk) 12:59, 28 July 2012 (UTC)[reply]
