Fair Use Rationale for 1999 Sydney hailstorm[edit]

I believe this image is justifiable in use as "fair use" under United States law because:-

  • It demonstrates an historical event where the image is integral to the article (or section therein).
  • No free alternative could be created, as this was a radar image and any derivative would still be fair use and not licensed freely.
  • The image does not inhibit the creator (the Bureau of Meteorology, operated by the Government of Australia) to make a profit (as a government agency, its purpose is to provide information to the public).
  • The use of this image is in line with the intention of the Bureau of Meteorology's operation - to educate, warn, and protect.
  • The image is an official radar image, where the contents and operation of the body that created it (Bureau of Meteorology) is integral both to the event and discussion of the event as presented in an encyclopedia article. The radar image and its use to warn citizens is immediately discussed in the article (or section therein), and hence qualifies for fair use because it is integral to this section of text.
