Flagging as PD, because picture is approximately 122 years old. It also predates 1923, so it's PD anyway. Furthermore, its first known publication (which does not indicate copyright, anyway; this being a family portrait provided by the family, the copyright would almost certainly have been vested in the family, not the publication they provided the photo to) was in The American magazine, May 1927, but according to this page and incopyright.org archive copy at the Wayback Machine this publication's copyright was not renewed, and neither was the article's individually.
