This image is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

2. The photo is only being used for informational purposes.

3. Its inclusion in the articles Trial of Clay Shaw, David Ferrie, and John F. Kennedy assassination conspiracy theories adds significantly to the articles because the photo and its historical significance are the object of discussion in the articles. The articles reference Jack Martin's statement to the FBI that David Ferrie had known Lee Harvey Oswald from their days in the New Orleans Civil Air Patrol, as well as Martin's statement that he had seen a photograph, at Ferrie's home, of Oswald in a Civil Air Patrol group.
