  • Detroit Tigers publicity photograph of Mayo Smith.
  • Such images were taken by a team photographer, and then disseminated to the media and the public for the purpose of promoting their players and personnel.

Public domain explanation

  • In the full image, seen here, the photograph includes the name of the subject. It does not, however, include the copyright symbol ©, the word "Copyright", or the abbreviation "Copr.", as then required for copyright.
  • By publishing the photograph without such a notice, under the terms of the 1909 Copyright Act (which was law until 1978) the image went into the public domain.
  • This was a common occurrence for publicity images disseminated in Major League Baseball.
  • If there is any chance that the photograph was copyrighted, under the terms of the 1909 Copyright Act this copyright would have had to be renewed 28 years after publication. A search for copyright renewal records reveals no trace that this occurred.
