The image linked here is claimed to be used under fair use as:

  1. it is a historically significant photo of a square and building made famous by the subject of the Harry Aubrey Toulmin, Sr. article;
  2. it is of much lower resolution than the original (copies made from it will be of very inferior quality)
  3. the photo is only being used for informational purposes.
  4. Its inclusion in the article adds significantly to the article because it shows the the Springfield, Ohio Fountain Square and The Bushnell Building as they appeared before the historical event of the installation of the general public memorial sculpture of Harry Aubrey Toulmin, Sr.. A free-licensed picture of Fountain Square and The Bushnell Building as they appeared before the historical event of the installation of the general public memorial sculpture is no longer possible since the installation of the memorial sculpture. There is still no reason why a fair use image has to be used instead of one that is free-licensed. The usage of this photo in the article is just to show "The Bushnell Building, Springfield, Ohio, where Toulmin developed the patent application's for the airplane". Everything jreferee said is true. However, the image is still "replaceable", so it fails our first fair use criterion. It may be legal for us to use it, but it's against Wikipedia policy. – Quadell (talk) (random) 16:41, 20 October 2006 (UTC)[reply]
