The use of this image in the article Ján Ducký has been disputed, because it "illustrates a subject for which a freely licensed media could reasonably be found or created that provides substantially the same information or which could be adequately covered with text alone". While I do not know if the following points constitute evidence of this image being the most suitable for the above-mentioned article or indeed for keeping it on Wikipedia, but I put forth the following:

1. A freely licensed media depicting the subject might not exist. This image, provided by the Slovak police to news agencies and media outlets is the only representation known to exist. As picture-capturing capabilities were not massively widespread in Slovakia at the time in question and the crime scene was guarded by the police, it is possible, yet highly unlikely that anyone else managed to take pictures of the crime. No other set of images ever emerged.

2. The image as such is thus unique and irreplaceable. It depicts one of the hallmarks of Slovak history of the 1990s and being the only visual evidence, it can principally not be covered by text.

2. This image is a low-resolution TV grab and it might be replaced by another version of this image as published by another media, with the copyright issues still remaining.
