The image was used on TONMO.com's "giant and colossal squid fact sheet" earlier than 1/4/07 so it seems likely that the claim of ownership is entirely fabricated. I am going to confirm the source, artist, and attribution of the image with Dr. O'Shea, but it may need to be removed, and almost certainly needs a change in attribution. The current version of the source document is here:
