Why fair use?

Why is this tagged as a fair use image? The cover itself is in the public domain. The photo may be copyrighted because of its creativity (i.e. the angle at which the books are photographed, the lighting, etc). If that's the case, it is easily replaceable with a different scan of the cover that is not copyrighted. Even a Google Books screen grab of the title page would make a fair replacement. --Midnightdreary (talk) 20:24, 6 January 2021 (UTC)
