Justification for fair use for Yitzhak Kaduri[edit]

First it appears that this image has not been copyrighted, at the time of uploading, it was originally taken from the Hebrew website which had represented the rabbi during his life(Kaduri.net). This site does not contain copyright notifications in English translations. One site, News First has claimed copyright for a copy of the image with its own logo superimposed, this image has not been used. The original image has since been copied and published by other sites.

Second, even on the precarious assumption that US copyright does apply, the question which has lead to considerable discussion and debate on the talk page of this page is whether or not the note is written in the rabbi's own hand. Repeated attempts to contact the owners of the holding website to suggest obtaining GDFL have gone unanswered. There is therefore a strong case for fair use, as I understand it. The appearance of the handwriting and the signature is therefore directly material to the debate.
