Keep. The image is stock photo from the Corfu Municipality. As such it is a promotional image that was created by the municipal government of Corfu to promote Corfu, its history and architecture. It cannot be recreated today because buildings have surrounded the City Hall and the perspective shown has been irrevocably lost. A free alternative cannot be created that would give the same perspective and as such it would be impaired esthetically. User Hbdragon88 is absolutely correct in his comment. If the municipal government of Corfu owns the image and wants it to be widely used, you should have no trouble getting them to agree to a free license. That is, if they are in fact the copyright holder, which we have no evidence of. Futher, if we had a freely licensed current image, we could edit it if the buildings next to this one are such an "aesthetic impairment". Jkelly 19:20, 28 August 2006 (UTC)[reply]

was tagged as pd but is copyright from a publication published in 1954 United States Army in World War II European Theater of Operations where it is marked as "captured german photograph". This was a cleaned up version of a picture already on the article page (uploaded by another user). All German WWII pictures are out of copyright under German law - I'm really not sure what the issue is with this image. Just because it featured in a 1954 book makes no difference it was an official german picture and therefore is now out of copyright. Pd-old appears to be the correct licence. That is the issue here. Is it or isn't it out of copyright. Apparently aulthaugh it had been out of copyright. German wartime pictures are back in copyright, as the longest EU copyright counts after the last EU law. There have been a few pictures already deleted for that reason. If it was out of copyright there would also have been no need to delete it from commons. As I said on your page I would like a permanent record of this to stop later arguments cropping up again and again. Agathoclea 18:20, 26 August 2006 (UTC)[reply]
No the 1954-thing is not about wartime pictures it's about "Lichtbild" (just a photo) vs. "Lichtbildwerk" (a thoughtfully taken photo, which qualifies for artwork). "Lichtbilder" have a 50 year copyright after publication, "Lichtbildwerke" have a 70 years pma. Altthough the Lichtbild"-term still exists in current German copyright it is of no practical use for us as courts have dramatically lowered the requirements for classifying a photo as "Lichtbildwerk". Nowadays virtually every photo is considered a "Lichtbildwerk" and it probably just depends on your lawyer convincing the court that a certain image is indeed artwork. As I was asked for a comment here some backgrounds: As far as I can remember this image is a black and white version of a color picture and the original images has been taken by a photographer called Walter Frentz (see de:Walter Frentz, he died in 2004) and the image is still copyrighted (there were lawsuit in Germany that back Frentz' and his sucessors' claims against claims that the images are public domain per se or in property of Germany). The copyright (or better to speak with the terms of continental european authorship right: all exclusive usage rights) of virtually all existing color images of Hitler has been waved by Frentz to Ullstein Bild, a stock image agency agressively pursuing its rights. More than a year ago, we had a brief contact with them (found an archive entry at [1], see my comment a little bit down in the thread, ok it's all written in German... There is also an entry in the Wikimedia-OTRS I could search for). They demanded from us (German language Wikipedia in particular) removing all their images from all Wikipedias within a short timeframe as they otherwise would take legal action. We thatfor removed/urged people to remove the pictures in every local community, which was achieved after a day or so. So we luckily were able to avert the legal action by Ullstein. So in any case this image needs to be deleted in order to avoid any trouble and if you happen to find a Hitler image in color somewhere in Wikipedia please take a deep look if it is really legal and if not place it asap on deletion candidates. This image is Lipadom.jpg, which was deleted as a result of copyright violations on Wikipedia [2] [3] and uploaded on commons for safekeeping when it became obvious that it will be deleted. This picture was then also deleted from commons by name of Lipadom.jpg [4] and Neo-ustase.jpg [5]. Now it's again uploaded on Wikipedia. -- Vision Thing -- 16:44, 26 August 2006 (UTC)[reply]
