Dear Wolfgang Koch,

Thank you very much for the positive answer. The Wikipedia community
is pleased to have such an important company supporting our efforts to
bring quality content to the world.

The copyright holder will need to choose a Wikipedia compatible
license (GNU Free Documentation License, Creative Commons Attribution
or Creative Commons Share Alike) for the images so that we can
effectively use them (every image uploaded in Wikimedia projects must
have a license). I suggest Creative Commons Share Alike version 2.5 (
http://creativecommons.org/licenses/by-sa/2.5/ ), this way the images
will be credited to Napalm Records in the way you decide, ensuring
modified versions of the original images also credit Napalm Records as
the copyright owner of the original.

I must stress again that, by allowing Wikipedia to use the images
through a free license, you are also allowing, due the nature of these
licenses, the reuse of such images by any individual or company, for
commercial and non commercial purposes, as long as they recognize
Napalm Records as the copyright owner and follow the local laws.

If you do not feel comfortable with the previous paragraph, you can
restrict the scope so that only promotional images of the bands can be
licensed (thus the images appearing in
http://www.napalmrecords.com/promo/visions/visionsphoto.shtml in the
case of Visions of Atlantis could be used, but not the images of the
album covers found in
http://www.napalmrecords.com/promo/visions/visionsmain.shtml ). Or
even more restrictive, and specifically tell us which images are
available under a free license.

I know you have already stated your will, however Wikimedia asks us to
get sure the copyright owner understands everything. As a last step in
our formal process of verification, I ask you to review the following
"letter", which is the suggested format we use at Wikipedia (
http://commons.wikimedia.org/wiki/Commons:Email_templates ) plus some
modifications done to match the current situation, to choose the
license and to either agree or disagree with the wording:

Napalm Records hereby asserts that it is the creator and/or sole owner
of the exclusive copyright of the promotional material appearing in
the website http://www.napalmrecords.com.

Napalm Records agrees to publish that work under the free license [GNU

Commons Share Alike -> please specify which one/ones].

Napalm Records acknowledges that it grants anyone the right to use the
work in a commercial product, and to modify it according to their
needs.

Napalm Records is aware that it permanently retains both the copyright
of its product and the right to be attributed in accordance with the
chosen license. Modifications others make to the work will not be
attributed to Napalm Records.

Napalm Records is aware that the free license only concerns copyright,
and it reserves the option to take action against anyone who uses this
work in a libelous way, or in violation of personality rights,
trademark restrictions, etc.

Napalm Records acknowledges that it cannot withdraw this agreement,
and that the image may or may not be kept permanently on a Wikimedia
project.

This is basically a summary of what has been said, acknowledging free
images may be used commercially, that the agreement cannot be
withdrawn, that Napalm Records retains the copyright and reserves the
option to take action against those utilizing the work outside customs
or law. If Napalm Records agrees with the letter, please state so in a
reply so that it can be archived in our system. Otherwise, or if any
section is confusing, please tell me so that I can explain further.
Note that, since only the copyright holder can give consent, it is
advisable that a legal representative of the company review the
matter.

I trust you will find these terms acceptable. If you have any question
or special request, please feel free to elaborate. Once the terms are
set, I will upload an image in Wikimedia Commons with the chosen
license and attribution, use it in the different languages of
Wikipedia, and send you the links so that you can verify the usage and
attribution.
