Draft:Nationwide Investigation Advisory Committee

The Nationwide Investigation Advisory Committee (NIAC) is a group within the United States Department of Justice (DOJ)

Process

The NIAC receives it's guidance from the Department of Justice’s (DOJ) Computer Crime and Intellectual Property Section (CCIPS) to approve language to the entire Department of Justice community for Search and Seizure warrants.

The NIAC approves the language used by the Department of Justice's (DOJ) Child Exploitation and Obscenity Section (CEOS)

Purpose

The committee writes the boilerplate templates used to draft search and seizure warrants used by the FBI, HSI, police and other law enforcement agencies for nation wide operations. For example the NIAC would write a template for the:

• Affidavit in application for a search warrant,
• Attachment A in such a federal search warrant describes the particularity of the place to be searched.
• Attachment B in such a federal search warrant describes the particularity of what the searchers are allowed/supposed to search for to be seized.

Example language drafted by the committee in a search warrant:

• Attachment A language: The property to be searched is ((PREMISES ADDRESS)), further described as

((a red brick house))"

• Attachment A language: The entire property located at ((ADDRESS)), including the residential building, any

outbuildings, and any appurtenances thereto (the SUBJECT PREMISES). ((INSERT FURTHER DESCRIPTION OF THE SUBJECT PREMISES AND/OR A PICTURE OF THE SUBJECT PREMISES))

The complete list is not published or known at this time, however FOIA requests have yielded that the Deputy Chief of the DOJ's Criminal Division, Child Exploitation and Obscenity Section is likely a member.
