The use of this image in the article Marry the Girl qualifies under the "fair use" doctrine because:

  • It is a low resolution copy of publicity photograph for the show.
  • Although most (75%) of the image is used, it is too small to compete with the copyright owner's use of the image;
  • Its use will not deprive the copyright owner of income or the ability to use and exploit the image;
  • It is used for the purpose of identifying and illustrating the farcical production style of Marry the Girl in the context of the series of plays known as the "Aldwych farces". This image is the sole visual illustration of that production style in the article; and
  • It cannot be replaced by an equivalent free image; both people shown are dead.
