incorrect redirect[edit]

Court of Appeal redirected to the *US* Court of Appeals, which is clearly a different entity. Something is wrong, not sure how to fix. Breaking link, for now.

Situation outside England and Wales[edit]

Seamanrob When you make reference to P&O in the sheen report (reference 4), you are incorrect in saying P&O - although P&O were the owners at the time, the report clearly states in 3.1 (the parties) "At the time of the casualty the HERALD was owned by Townsend Car Ferries Limited (hereinafter "the company"), which was a subsidiary of the Peninsular and Oriental Steam Navigation Company (hereinafter "P&O") The actual part you quote is section 14.1 - The Management - Which before that line states "..that underlying or cardinal faults lay higher up in the Company..." - the company being Townsend Thoresen. The report also states in the first few pages "The Decision of the Court" - by the fault of Townsend Car Ferries Limited (the owners). Yes, P&O were the owners owner... but the fault lay with TTs management, which lets face it, was only just being looked at by P&O management as they had only purchased the company a few months before hand. The faults listed in report 8074 go back years..
