New article needed[edit]

I was surprised when "Hostile environment" redirected here automatically, since the term also is used for Hostile learning environment, which has no article. If and when I create the new article, Hostile environment without the qualifier should become an disambiguation page, but I don't think there should be a default link.FriendlyFred (talk) 16:05, 16 November 2014 (UTC)[reply]

Merger proposal[edit]

The phrase "hostile environment sexual harassment" is rarely, if ever, used in discussion of business ethics. Every textbook and academic journal I can find refers to it as a "hostile work environment" and that's it. (Google search hits are "hostile+work+environment" 481,000 to "hostile+environment+sexual+harassment" 30,300.) The two phrases are virtually interchangeable. Therefore, I'm proposing that Hostile environment sexual harassment be merged into Hostile work environment. American Eagle (talk) 03:41, 13 June 2015 (UTC)[reply]

Burdens of proof[edit]

Currently, a section titled "Burdens of proof" has one paragraph which mentions "hostile environment", then in the next paragraph lists conditions required for "Prima facie case for hostile work environment sexual harassment." It seems to me that is like bait and switch, where the bullet-point conditions are about a more specific subset of cases (sexual harrassment varieties) than the introductory paragraph topic. This structure almost seems to suggest that unless sexual harassment occurs, there is no hostile workplace. I would suggest that a more general set of "hostile workplace" conditions be bullet pointed before getting into specific sub-types. Gzuufy (talk) 21:57, 9 March 2016 (UTC)[reply]

Type of workplace effects what is defined as a "hostile work environment"[edit]

The article fails to mention how the type of work environment can effect whether their is a "hostile work environment" is created in a particular situation. The supreme court has said that context is important when determining whether something is cosidered sexual harassment. An example they used was the situation of a butt slap on a male player by a coach after a game vs a male boss doing so with his female secretary. What this all means is that, for example, a person working at such places as a legal Nevada brothel, a pornographic website, or an adult comedy club would be expected to have different expectations of the level of sexual talk or sexual things in the environment where they worked. Thus a female secretary at such a place could not claim a hostile a work environment simply because she overheard talk about sex, heard sexual/dirty jokes, saw naked people, or pornographic pictures, etc. while at work. In California, there was an important State supreme court case involving this issue where a woman employed as a writers assistant for the TV show friends sued for sexual harassment by the writers staff for sexual talk during writing meetings. The court held that the creative work environment needed to write scripts for Friends episodes necessitated greater leeway in the level of sex talk in such an environment.
