Council of State's opinion[edit]

After an approval at the first reading, the bill goes to the Council of State for the opinion. The Council could recommend the second reading, if views the bill negatively. If the second reading is not recommended, then the bill is promulgated and published in the official journal. See this bill as example (see especially the second table from the bottom on the website). I suppose that the Council has one month to submit the opinion. Correct (well, first/second vote, rather than reading and Council of State must agree rather than recommend), but this is just a formality, they almost always agree to skip the second vote. Of course it needs promulgation. And it doesn't need the Council of State's avis, which is the opinion given to bills before a parliamentary vote. After the (first) parliamentary vote, a second one needs to happen, except if the Council of State agrees to skip that second vote, which is generally granted. It's a bit of a peculiar process (see article 59 of the Constitution). And after that agreement, the legislative process is formally complete, after which the Grand Duke can promulgate it and then the bill is published in the Mémorial (which should happen somewhere in July, the Minister of Justice said). The bill goes into effect six months later, which would thus be January 2015 if the previous steps go well. SPQRobin (talk) 21:41, 18 June 2014 (UTC)[reply]
The Grand Duke has no say in the matter Grand_Duke_of_Luxembourg#Constitutional_role, all it needs is to be published in the gazette (memorial). I will delete the reference to the Grand Duke. 24.108.58.1 (talk) 05:12, 29 June 2014 (UTC)[reply]
He needs to promulgate the law (it doesn't really matter if that's mentioned in the article or not), but you are right in the sense that he is no longer formal part of the legislative process (i.e. no royal assent needed), so technically the law has been adopted.
