Image:Undertow xbla.jpg is being used on this article. I notice the image page specifies that the image is being used under fair use but there is no explanation or rationale as to why its use in this Wikipedia article constitutes fair use. Compensation vs. Pat on the back

If you read the wording of the announcement from Microsoft, Undertow isn't actually being given as compensation for Live issues, but as a celebration of the success of the service:

"At the same time we would like to offer a token of our appreciation to all of you in celebration of record success for the service. And as a thank you for your loyalty during this holiday period, we will be offering all of our Xbox LIVE members around the world access to a full Xbox LIVE Arcade game that will be available to download free of charge. DLC

See no section about the extra content, should someone add a little sentence like: "Made available on the Market Place an expansion pack (Release date), allowed players to play as the alien race encountered towards the end of the game and even giving the aliens there own campaign."
