Title[edit]

The Wisconsin Constitution Article IV [1] clearly states that the legislature has two houses...the upper one is called the senate EdwinHJ | Talk 21:19, 15 December 2007 (UTC)[reply]

I'm late to the debate, but I'm wondering if "Wisconsin State Senate" is a more appropriate title than "Wisconsin Senate". To summarize my argument, I believe that the Constitution and state statutes do not address the issue; that courts and the media are divided; but that the body itself consistantly has referred to itself in recent years as the "Wisconsin State Senate".

Wisconsin Constitution: The constitution does not use either construction, only saying "the senate," (note the lowercase) as EdwinHJ mentioned. (Art. IV Sect. 1, 2, 4, 17; Art. 7; Art 12 sect 2; Art 13 sect. 9; etc.)
Wisconsin statutes: A wash The statutes do not refer to either the "Wisconsin State Senate" nor the "Wisconsin Senate". There are many references to "the senate" and two to "the state senate." (Wis. Stat. sec. 45.04; Wis. Stat. sec 52.05(1)(c)2).
Court cases A wash 1: The body is referred to as the "Wisconsin State Senate" in the following cases (among others):
- Helgeland v. Wisconsin Municipalities, 745 N.W.2d 1 (Wis. 2008) ("Wisconsin State Senate" listed as co-appellant)
- State v. Chvala, 678 N.W.2d 880 (Wis. App. 2004). ("Chvala, a Democrat, was elected to the Wisconsin State Senate in 1984.")
- Citizens Utility Bd. v. Klauser, 534 N.W.2d 608 (Wis. 1995). "Petitioner Risser was the Assistant Minority Leader of the Wisconsin State Senate...")
Court cases 2: BUT the body is referred to as the "Wisconsin Senate" in the following cases (among others):
- State ex rel. Fiedler v. Wisconsin Senate, 454 N.W.2d 770 (Wis. 1990) (case title)
- State ex rel. Wis. Senate v. Thompson, 424 N.W.2d 385 (Wis. 1988) ("The petitioners are the Wisconsin Senate and its president...")
News coverage: wash News outlets refer to the body both as the "Wisconsin State Senate" and the "Wisconsin Senate."

Galloway resignation[edit]

Pam Galloway submitted a formal letter indicating that she would resign effective midnight tonight ref. That means she is still an office-holder and should not be removed from this page until after her resignation is actually official.
