Justifications of Morality[edit]

At the bottom of the page and some on the talk page explains to us that some people think blackmail is a crime and some think not. Why would some people decide to blackmail and what type of people would generally think this way?

Blackmail Morality[edit]

More in-depth with this social aspect of blackmail. Now before when talking about the justifications of morality a big aspect is talking about the wrongs and certain ideas that the blackmailer and the victim went through; proceeding to break it down even more by stating some facts on why the blackmailer would do such things. Two factors in which blackmail can be categorized would be the emotional state on which victims can be used through emotion and extortion in where victims can be used through physical items and objects that they may possess.'

Emotinal Blackmail[edit]

  • Blackmailers on who are their generally targeted victims

- Emotionally unstable victims (can't control their emotions and are easily manipulated) 60% of the time are cases from people from within the family circle. This would make logical sense since the blackmailer would have more of an emotional connection with the victim. A lot of the blackmailers would use guilt-tripping which is a designed threat in which the victim would feel guilty in then will cause for some type of negative outcome. This is ultimately what the blackmailer wants.Many times the guilt is implied and the demand is not overtly stated.

  • Blackmailers who resort to emotional blackmail tend to be:
  1. Narcissists- people who tend to be proud and tend to think they are the best at everything, and they tend to look down on people
  2. Loud and Dramatic- People who create huge issues out of nothing tend to point out problems at people around them.
  3. Passive Aggressive- Aggressive people who tend to use emotional blackmail are their strategy. Since they cant express emotion directly they tend to use it though sarcasm or abuse as a manipulation of their self-defense system.
  4. Insecure/Low self-esteem- People who can't control their feelings so they use other methods of control.

Extortion[edit]

-"These threats can be those of violence, physical harm, criminal prosecution, or public exposure of harmful or secret information that would damage a person’s reputation and/or standing in the community", also it can be described as when a blackmailer uses embarrassing information to potentially reveal to his or her family to incriminate the victim unless there is some type of demand for money, property, or any other type of service that is agreed or met upon.

Law on Blackmail[edit]

Extortion and blackmail when it comes to the laws are considered to have the same consequences. Its considered a felony by most of the states in the U.S.A and could be punishable by fines, probation. Blackmailers in some cases would even have to restitute payable to the victims. Though its a felony in most states the charges vary from state to state. The main thing that needs to carry out in order for the crime to be committed is a verbal or printed threat is being made and the intention is purposefully because if not the case can go a completely different way.   3. The Hobbs Act
  4. The Racketeer Influenced and Corrupt Organizations (RICO) Act
  5. Title 18 of United States Code - Chapter 41: Extortion and Threats

Law of Extortion[edit]

- According to the law of extortion, its mainly done by criminal groups rather than individuals. If the criminals are caught whatever they obtained isn't the offense The obtaining of property from another induced by wrongful use of actual threatened force, violence, or fear, or under color of official right. Under the Common Law, extortion is a misdemeanor consisting of an unlawful taking of money by a government officer."
