1889-1903, 31 senators[edit]

Senators serve four-year terms, with one half of the senate elected every two years. Those elected to the 1st Legislative Assembly in 1889 were elected to two-year terms, and had to stand for reelection in 1890. The North Dakota Constitution of 1889 required the Legislative Assembly to separate the senate into two classes, with one class elected 1890 serving two-year terms and the other class serving four-year terms. The 2nd Legislative Assembly assigned senators from odd-numbered districts to the first class and even-numbered districts to the second class.

1903-1909, 40 senators[edit]

40 senators elected from single-member districts. Due to the reapportionment, senators in districts 33, 35, 37, and 39 were elected in 1902 to two-year terms, instead of four. They stood for relection with the rest of the senators from odd-numbered districts in 1904 to maintain the constitutional requirement for that one-half the senate be elected every two years.
