1828 Act 9 G4 c82 references earlier acts:

  • WHEREAS by 5 G3 c15 ss11,22 certain Provisions were made with respect to the lighting and cleansing of Cities, for the lighting and cleansing of which no particular Provision was made by any Acts of Parliament then in force
    • s11 explains wrt cities 1 G3 c17 s20, which broadened 33 G2 c18, and was prolonged by 25 G3 c54 s3 to 1806
      • 1 G3 c17 s20 refers to [6 G1 c18] (amended by [8 G1 c16], [3 G2 c22], and [15 G2 c11]) applying to Dublin Cork Limerick, and expiring; says Dublin will prolong whereas Cork and Limerick will revert to 33 G2 c18 instead
      • 33 G2 c18 prolongs [6 G1 c18], [8 G1 c16], [3 G2 c22], [11 G2 c19] (s24 p.784) for Dublin lights [and adds more]; and extends to other towns (s27 p.785) by meeting [called by "chief magistrate" if corporate, otherwise 2 JPs of county] of heads of households worth £5 annual rent
    • s22 sets expiry to 1773, but was prolonged by 19&20 G3 c14 s10 to 1787 and by 25 G3 c54 s2 to 1806 (& 1827 by 47 G3 st1 c42)
  • And Whereas the said Provisions were amended by 13&14 G3 c20 ss1,7
  • And Whereas the said recited [5 G3 c15], so far as the same relates to the lighting and cleansing of the said Cities, was further amended and continued by 25 G3 c54 s3
  • And Whereas by 36 G3 c51 the Regulations and Powers of the said hereinbefore recited Acts were extended to Towns Corporate and Market Towns, not being Cities
  • And Whereas by 47 G3 st1 c42 so much and such Parts of the said hereinbefore recited Acts as relate to the lighting, cleansing, and watching of any Cities, Towns Corporate, or Market Towns, in Ireland, for the lighting, cleansing, and watching of which no particular Provision is made by any Act of Parliament in force in Ireland, were continued for Twenty-one Years;
  • and by [9 G4 c7 — Act summary or Bill full] so much and such Parts as aforesaid of the said several recited Acts are continued for One Year, and from thence until the End of the then next Session of Parliament, unless Provision shall in the meantime be made by Parliament for the Repeal of the said Acts, or of any of them
    • Bill mentions 5, 13&14, 25, 36, and 47 G3 above; Act summary omits 47.
  • And Whereas the Provisions so made have not answered the good Purposes thereby intended, and it would greatly tend to the Improvement, good Order, and Security, and much promote the Trade and Prosperity, of the several Cities, Towns Corporate, Boroughs, Market Towns, and other Towns throughout Ireland, if effectual Provisions were established for the Purposes aforesaid, in lieu of the Provisions contained in the said recited Acts, and also for the Purpose of paving such Cities, Towns Corporate, Boroughs, and Market Towns, and for such Purposes as are hereinafter mentioned
  • Be it therefore enacted by the King’s most Excellent Majesty, by and with the Advice and Consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the Authority of the same, That from and after the passing of this Act so much and such Parts of the said several hereinbefore recited Acts, or any of them, as relate to the lighting, cleansing, and watching of any Cities, Towns Corporate, or Market Towns, in Ireland, for the lighting, cleansing, and watching of which no particular Provision is made by any Act of Parliament in force in Ireland, shall be and the same are hereby repealed

    • Tullow: We referred in our last report to the difficulty which had occurred in carrying on the administration of the municipal affairs of the town of Tullow, owing to the absence of a sufficient number of persons qualified to act as Commissioners. Acting on the representations made by us, the Carlow County Council appointed five members to fill up the vacancies, thus restoring the body of the Commissioners to its full membership. These members, however, resigned office in December after certain liabilities of the Commissioners had been discharged, and a dead¬lock was again created. No nominations for the vacancies were forthcoming at the elections required to be held in January last, and, accordingly, there is still no body of persons qualified to act as Commissioners. In the absence of further steps being taken by the Carlow County Council, the administration of the affairs of the town cannot be carried on, and there is no machinery provided by law by which the town of Tullow can be re-absorbed for all purposes into the rural district in which it is situated.
