Question

Thanks again for your answers at the entertainment ref desk FW. I sure remember the 2005 United States Grand Prix. It is still one of the oddest races I've seen. In the wikiarticle for the race the lead has the following sentence:

It was later revealed that the Michelin-shod teams could have potentially exposed themselves to criminal liability under Indiana state law had they competed.

But I can't find any followup to that in the body of the article - Now I read through it twice but that doesn't mean that I might not have missed something :-) I am wondering what law they would have been criminally liable under. If you think clarification could be added to the article that would be great. OTOH if you think that article is okay as is that is fine as well. Thanks for your time. It would presumably be normal workplace health-and-safety laws, which are basically comparable in at least most western countries. The drivers are employees, and employers (the teams) are responsible for taking reasonable steps to ensure their workers have a safe working environment. The inherent danger of motorsport, and the drivers' awareness of and consent to that danger, might go some way to reducing the risk of a prosecution, but certainly not entirely. It's a bit like a firefighter - everyone knows a firefighter's job is intrinsically dangerous, and most on-duty injuries of firefighters aren't held to be the fire department's fault - but if the fire department knowingly provided some equipment (say breathing masks) that it knew to be defective, that could be criminal neglect. That's, broadly speaking, the argument in the prosecution of the Williams people following the Death of Ayrton Senna. But I don't know anything about the specific law. For Wikipedia's purposes, it doesn't really matter - so long as we have a WP:RS that cites the teams saying that they thought it might run that risk, that's all we need to say. -- Finlay McWalterᚠTalk 18:10, 25 May 2015 (UTC)
