Copyright on Wikipedia[edit]

Copyright problem icon One of your recent additions has been removed, as it appears to have added copyrighted material to Wikipedia without evidence of permission from the copyright holder. If you are the copyright holder, please read Wikipedia:Donating copyrighted materials for more information on uploading your material to Wikipedia. For legal reasons, Wikipedia cannot accept copyrighted material, including text or images from print publications or from other websites, without an appropriate and verifiable license. All such contributions will be deleted. You may use external websites or publications as a source of information, but not as a source of content, such as sentences or images—you must write using your own words. Wikipedia takes copyright very seriously and persistent violators of our copyright policy will be blocked from editing. See Wikipedia:Copying text from other sources for more information. You are creating articles using entire phrases from copyrighted sources. Please ensure when creating articles you are using your own words and not lifting wholesale text or close paraphrasing from outside sources. As you are new to Wikipedia, I strongly suggest you use the Articles for Creation process to create new articles until you have a better understanding of our policies and guidelines regarding sourcing, notability and copyright. Thank you, -- Jezebel's Ponyobons mots 18:46, 27 November 2018 (UTC)[reply]

Block notice[edit]

Stop icon
You have been blocked indefinitely from editing for disruptive editing through the repeated introduction of copyright violating text to Wikipedia despite multiple warnings. Instead of making the effort to understand why your articles were being deleted, you simply blanked the messages provided to you and renamed the articles in order to bypass the create protection put in place to prevent further copyright violations. You can be unblocked once your agree to abide by Wikipedia's policies regarding copyright and close paraphrasing. I would also like to see an agreement from you that you will use WP:AfC for article creation moving forward, as I suggested here, as a condition of any unblock, but will leave that to the reviewing admin.
If you think there are good reasons for being unblocked, please read the guide to appealing blocks, then add the following text below the block notice on your talk page: {{unblock|reason=Your reason here ~~~~}}.  Jezebel's Ponyobons mots 19:15, 27 November 2018 (UTC)[reply]

Request reason:

edits made after deletion notice to avoid copyright infringement, including additions of new sources. Complete deletion of pages excessive. IkhSain (talk) 19:22, 27 November 2018 (UTC)[reply]

Decline reason:

I am declining your unblock request because it does not address the reason for your block, or because it is inadequate for other reasons. To be unblocked, you must convince the reviewing administrator(s) that

  • the block is not necessary to prevent damage or disruption to Wikipedia, or
  • the block is no longer necessary because you
    1. understand what you have been blocked for,
    2. will not continue to cause damage or disruption, and
    3. will make useful contributions instead.

Please read the guide to appealing blocks for more information. Yamla (talk) 19:31, 27 November 2018 (UTC)[reply]

If you want to make any further unblock requests, please read the guide to appealing blocks first, then use the {{unblock}} template again. If you make too many unconvincing or disruptive unblock requests, you may be prevented from editing this page until your block has expired. Do not remove this unblock review while you are blocked.

Request reason:

I understand that copyright laws are stricter in the United States versus Canada, and now I understand that given the differences in copyrights around the world, wikipedia defaults to the highest level protection. I was disheartened to see the pages deleted entirely rather than have have sections of the pages deleted or modified more drastically. I believe the pages I created serve a purpose, so I editted them trying to avoid the copyright issues. One method of preserving copyright I should have used was "quoting", and limiting the text with adding a link to original source by using "External Links" or "See Also". I am new to wikipedia, so I did not understand the processes for avoiding a deletion. I went about the process in the wrong way. I understand that I may have been initiating an "edit war" which was not not my intention and for that I apologize unreservedly. And if I am allowed to continue I will strive to follow copyright rules and become a better, more collaborative wikipedia editor.

Decline reason:

In order to lift the block, we need to be certain that you understand how copyright works on Wikipedia. To allow the reviewing administrator to assess your understanding, please respond to the following questions in your next unblock appeal, explaining in your own words:

  • What is copyright?
  • How is Wikipedia licenced?
  • Why is copyrighted content not allowed on Wikipedia?
  • Under what circumstances can we use copyrighted content?
  • How do you intend to avoid violating the copyright policy in the future?

Your answers will enable us to establish whether or not you should be unblocked. Yunshui  08:29, 28 November 2018 (UTC)[reply]

Copyright in Canada is almost exactly the same as copyright in the United States. Furthermore, extensive quoting would also be inappropriate here. --Yamla (talk) 02:47, 28 November 2018 (UTC)[reply]

Request reason:

1. What is copyright? According to the Government of Canada copyright is "the exclusive legal right to produce, reproduce, publish or perform an original literary, artistic, dramatic or musical work. The creator is usually the copyright owner. However, an employer—for example, a film studio—may have copyright in works created by employees unless there is an agreement in place stating otherwise." Wikipedia's definition of "Copyright is a legal right, existing in many countries, that grants the creator of an original work exclusive rights to determine whether, and under what conditions, this original work may be used by others.[citation needed] [1] This is usually only for a limited time. The exclusive rights are not absolute but limited by limitations and exceptions to copyright law, including fair use. A major limitation on copyright on ideas is that copyright protects only the original expression of ideas, and not the underlying ideas themselves." 2. How is Wikipedia licenced? "The text of Wikipedia is copyrighted (automatically, under the Berne Convention) by Wikipedia editors and contributors and is formally licensed to the public under one or several liberal licenses." Wikipedia:Copyrights "the mission of the Wikimedia Foundation is to "empower and engage people around the world to collect and develop educational content under a free content license". Resolution:Licensing policy "The licensing policy of the Wikimedia Foundation expects all content hosted on Wikimedia projects to be free content" Wikipedia:Non-free content 3. Why is copyrighted content not allowed on Wikipedia? "Wikipedia's goal is to be a free content encyclopedia, with free content defined as content that does not bear copyright restrictions on the right to redistribute, study, modify and improve, or otherwise use works for any purpose in any medium, even commercially." Wikipedia:Non-free content 4. Under what circumstances can we use copyrighted content? Permission is one circumstance that Wikipedia can use copyrighted works. According to the Canadian Copyright Act and University of British Columbia (UBC): "Fair dealing is a user right contained in the Copyright Act. Fair dealing allows you to copy from a copyrighted work, without the copyright owner's permission, if: the copy is for one these purposes: research, private study, education, parody, satire, criticism, review or news reporting; and your dealing (use) is fair." UBC goes on to write: "Neither the Copyright Act, nor the decisions of the courts interpreting fair dealing set out exactly what is fair in any particular instance. Rather, to determine whether a particular copy qualifies as a fair dealing, one must consider all of the relevant factors, including the following: *the purpose of the proposed copying, including whether it is for research, private study, education, parody or satire, criticism, review or news reporting; *the character of the proposed copying, including whether it involves single or multiple copies, and whether the copy is destroyed after it is used for its specific intended purpose; *the amount of the dealing from the individual user's perspective, including the proportion of the work which is proposed to be copied and the importance of that excerpt in relation to the whole work; *alternatives to copying the work, including whether there is a non-copyrighted equivalent available; *the nature of the work, including whether it is published or unpublished; and *the effect of the copying on the work, including whether the copy will compete with the commercial market of the original work." I believed my use of the material fell under the education and research categories of fair dealing. I now understand that Wikipedia defaults to a higher level due to it's cross-jurisdicitonal nature. 5. How do you intend to avoid violating the copyright policy in the future? I intend to avoid violating Wikipedia Copyright Policy in the future by writing in my own words, using quotes with clear to reference to source material, and directing interested parties to source material with links in page sections such as "External Links", "See Also" and/or "Further Reading". I will avoid the use of close paraphrasing which is the "superficial modification of material from another source." Wikipedia:Close paraphrasing
