File copyright problem with File:JonLeeBeachVolleyballPlayerCoach.jpg[edit]

It may be deleted soon, unless we can verify that it has an acceptable license status and a verifiable source. Please add this information by editing the image description page. You may refer to the image use policy to learn what files you can or cannot upload on Wikipedia. The page on copyright tags may help you to find the correct tag to use for your file. If the file is already gone, you can still make a request for undeletion and ask for a chance to fix the problem.

While it's true that www.bvbinfo.com may be a "public" database, the photos used on that website are not freely licensed according to this disclaimer. The photographer who took the photo of Lee, in this case Ken Delgado, is the copyright holder of the image. So, unless you are the same Ken Delgado, you will most likely not be able to upload this image to Wikipedia without them agreeing to freely license the image. The copyright holder may donate the photo to Wikipedia as explained in Wikipedia:Donating copyrighted materials if they so choose. They can upload the image to Wikimedia Commons and send a declaration of intent to Wikipedia:OTRS which clearly states that they agree to freely license the image. You can request that they do this by sending them an email (See Wikipedia:Example requests for permission) and asking them to do so if you like. Please note that a "free" license means that the photographer/copyright holder agrees to allow their photo to be modified, redistributed or used for any purpose (including commercial). It's not enough for Mr. Delgado to agree to let you use the photo for just Wikipedia; He has to explicitly agree to let anyone anywhere in the world use the photo anyway they want. Many photographers are reluctant to do this with their photos there's no guarantee Mr. Delgado will agree to this, but if he does he should send the relevant declaration of consent to OTRS as explained in c:Commons:OTRS. -- Marchjuly (talk) 05:24, 4 December 2015 (UTC)[reply]
