(From US Copyright Office)[edit]

Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered “fair,” such as criticism, comment, news reporting, teaching, scholarship, and research. Section 107 also sets out four factors to be considered in determining whether or not a particular use is fair:

the purpose and character of the use, including whether such use is of commercial nature or is for nonprofit educational purposes;

the nature of the copyrighted work;

amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

the effect of the use upon the potential market for or value of the copyrighted work. The distinction between “fair use” and infringement may be unclear and not easily defined. There is no specific number of words, lines, or notes that may safely be taken without permission. Acknowledging the source of the copyrighted material does not substitute for obtaining permission.

The 1961 Report of the Register of Copyrights on the General Revision of the U.S. Copyright Law cites examples of activities that courts have regarded as fair use: “quotation of excerpts in a review or criticism for purposes of illustration or comment; quotation of short passages in a scholarly or technical work, for illustration or clarification of the author's observations; use in a parody of some of the content of the work parodied; summary of an address or article, with brief quotations, in a news report; reproduction by a library of a portion of a work to replace part of a damaged copy; reproduction by a teacher or student of a small part of a work to illustrate a lesson; reproduction of a work in legislative or judicial proceedings or reports; incidental and fortuitous reproduction, in a newsreel or broadcast, of a work located in the scene of an event being reported.”

Copyright protects the particular way an author has expressed himself; it does not extend to any ideas, systems, or factual information conveyed in the work.

The safest course is always to get permission from the copyright owner before using copyrighted material. The Copyright Office cannot give this permission.

When it is impracticable to obtain permission, use of copyrighted material should be avoided unless the doctrine of “fair use” would clearly apply to the situation. The Copyright Office can neither determine if a certain use may be considered “fair” nor advise on possible copyright violations. If there is any doubt, it is advisable to consult an attorney.

Fair use[edit]

Your user page and User:Mike Nobody/II appear to contian a large number of fair use images. I'm afraid that these are not allowed in the user namespace. Could you please remove them?Geni 12:14, 5 January 2006 (UTC)[reply]

You are free to use images that are GFDL, Creative commons or public domain. Secondary use in non fair use contexts does reduce protection. Memory-Alpha and Uncyclopedia are not wikimedia projects and are therefore irrelivant. Asking you to remove those images is not censorship. Only goverments can censor. The use of a limited number of web-resolution screenshots for identification and critical commentary on the station ID or program and its contents on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. This is the license under which the big brother image at the top of this page is licensed under. You are in violation of it. Your signature is also, IMO, a violation of copyright. It is the only non-free image in my user space and will be deleted very shortly. Should these violations continue other, editors can and will replace them as Sam did. There are restrictions on what you may do in your user space. Violating the law is one of those restrictions. The above issue does not seem to be resolved, as you have a subpage full of copyright-infringing images which you have edited today. Is there any confusion on your part about whether or not this is okay that I, or someone else might be able to resolve for you? Sorry if the diff was confusing; I was just pointing out that you had been editing User:Mike_Nobody/II but had not removed the copyright-infringing images on it. Your response to me suggests that you might not be clear on which images at User:Mike_Nobody/II are being claimed as "fair use" for our articles. Image:Cats and dogs 002.jpg is one. You can tell this by clicking on the image and reading the licensing information underneath the image on the image page. Same with Image:Elfman02 satan.jpg, Image:Alice Cooper face.jpg, Image:GG ALLIN DEAD.jpg, and others. If you have problems identifying them, I'll be happy to help. It's not clear to me exactly how much information you are asking for. We don't distinguish unfree-licensed material based upon the copyright-holder's contractual agreements with the artist, or the material's primary purpose. Wikipedia:Fair use criteria forbids use of unfree-licensed images in userspace. While many people might like to decorate their userspace with such material, one of the agreements that one makes in contributing to Wikipedia is that one will not do so. Upon further research, your insinuation that this was to the American people is utterly baseless. He was goofing off before the taping of something else. He never bragged about it. He said in response to the laughs it garnered from the camera crew, "It's just my one fingered victory salute." It never went to air. It doesn't add anything to the article. It certainly doesn't belong in his religious beliefs section. You are in violation of WP:POINT and WP:NPOV. You just demonstrated the POV you are editing from and the point you were trying to make. Furthermore you have no way of knowing if he knew if the camera was on. Someone, in fact, can be heard in the background asking whether it was caught on tape. As for "official public record," something in the circumstances that this was shot in is off the record. I strongly dislike Bush. I was a campaign representative for Kerry. I have an anti-Bush userbox on my user page. I do not, however, find your antics appropriate. I thought the "Dean scream" thing was out of line, and that was on the public record. There are enough things for you to ridicule Bush for without inventing them. Your continued argument over this only intensifies my belief that you are trying to make a point and are incapable of editing GWB in a neutral manner. As I feel very strongly about Bush's candidacy, subsequent election (in my book he was only elected once), and presidency, I have largely refrained from editing his article, only making small corrections or strictly factual, fully refrenced edits to correct more major errors. Your signature[edit]

Your signature is in violation of Wikipedia policy (Wikipedia:Fair_use#Fair_use_policy), see #9 specifically. The image will probably be deleted soon anyway as the image itself is in violation of other sections of that policy. If the image is free clip art then one of two things must be true:
  1. You created it yourselff, in which case you must add some form of self attribution license to the image page
  2. You got it from a free use database of clip art, in which case you must state the source on the image page

You are correct that neither of these apply. I quote from the copyrights section: You are allowed to use the pictures for personal use as avatars, etc, but please don't say you drew them yourself ;) If you want to show them on your homepage add a link to this game. If you want to use them for bigger projects like cartoons, please send me an e-mail and tell me about it. Your use in your sig applies to the first sentence. Displaying it on Wikipedia would apply to the second. (Note that all images must be constructively used on a page somewhere or they risk being deleted.) The third sentence makes it very clear that it is not just not public domain, but not free use at all. This means that the only claim one could make to keep it is that it is fair use. According to policy, however, fair use images can't appear in the User namespace or in templates. Currently, those are the only places this image exists. I think it is unlikely to ever "contribute significantly to [an] article (e.g. identify the subject of an article, or specifically illustrate relevant points or sections within the text) and must not serve a purely decorative purpose." Since it seems you uploaded it for use in your sig, it doesn't meet policy. Sorry. I will note that however much I think it is annoyingly large, I do like your signature. Thanks for uploading Image:Lenny_Bruce_Mugshot_4-27-63.jpg. I noticed that the file's description page currently doesn't specify who created the content, so the copyright status is unclear. If you did not create this file yourself, then you will need to specify the owner of the copyright. If you obtained it from a website, then a link to the website from which it was taken, together with a restatement of that website's terms of use of its content, is usually sufficient information. However, if the copyright holder is different from the website's publisher, then their copyright should also be acknowledged.

As well as adding the source, please add a proper copyright licensing tag if the file doesn't have one already. If you created/took the picture, audio, or video then the {{GFDL-self}} tag can be used to release it under the GFDL. If you believe the media meets the criteria at Wikipedia:Fair use, use a tag such as {{non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair use. See Wikipedia:Image copyright tags for the full list of copyright tags that you can use.

I noticed their is a Wiki-project regarding the Ramones. Also, I know for a fact that Dee Ramone spent some time in the 1990's performing with Monster Bait and worked at a Harmony House in Allen Park Michigan. I know this because I was there.
