Photo by Evan Duning[edit]

Hi MildredJirak. You do have Evan Duning's permission to release that photo on Edmund Battersby under a free licence, don't you? Copyright is held by the photographer, so if you aren't the person who took it, they need to release the picture themselves. Hi Louise. They are not in violation of copyright. I own both of these photographs and have written permission from Evan Duning and Christophe Busckewicz to use the images. Please do not remove them. Hi, MildredJirak. I can't see any specific discussion regarding the pictures, or a fuller explanation of what's going on, so here goes.
The thing is, that releasing the pictures onto Commons also releases them under a free licence. Although you own the record label, that's not really what we're on about here. What we need to establish is (a) that you own the copyright to the pictures (and can prove it) and (b) can release these pictures under the licence you chose, which allows anyone else to use them for any other reason, including commercially so long as the reuser also makes them available for use and give you credit. Once those pictures are on Commons, you lose some control over their usage. In this case, it may be better that they are removed from Commons and not used on Wikipedia. You could always donate a photograph that can be released under a free licence while reserving others for the proper use of your record label.
The reason for these rules is fairly simple. Basically, Wikipedia is designed to be a 'free' encyclopaedia, not just 'gratis' (free of charge) but also 'libre' (freely distributable). Therefore, to avoid issues with copyright, what we need in artwork and photographs is not someone allowing us to use their photos to illustrate Wikipedia, but allowing those photographs to be used freely by other people (just like someone can come along and print a book based on articles in WP as long as they credit us and don't try to pass the text and pictures off as their own). Therefore your pictures should be potentially usable by others for purposes other than simply illustrating Battersby's article. I'm concerned that I don't think you realised what you were doing by releasing professional portraits of Battersby under a free licence - I think you thought you were just giving us permission to use them on Wikipedia, but as I said, they could be used by other people for other purposes if allowed to stand under a CC-BY-SA licence.
The unfortunate thing is that Wikipedia also has strict rules governing photographs of living people, and even though we have rules for using images under fair use criteria, since it is possible to get pictures of a living person such as Mr Battersby, then we don't tend to let pictures of living people through under fair use criteria (such as you giving us permission to use these on Wikipedia only but not releasing them under a free licence).
If you own the copyright and still wish to allow these photographs to be released under a CC-BY-SA licence, then you can make sure that OTRS know that this is what you intend (you need to get in touch with them to make sure everyone knows those photographs belong to you and you have given your permission to release them under a free licence; a disclaimer on this page may not be sufficient). However, it's a good idea to think carefully about whether this is what you want from the photographs, or whether the photographers (who would by default still own the copyright unless they transferred the rights to you) would object to their work being freely distributable under a CC licence.
I'm sorry this is a very long-winded explanation, but it's a complicated issue. I suggest you also read the WP:COPYRIGHT page and others I've linked very carefully - it might help explain the situation so you know what you're doing when you permit the photographs to be uploaded to Commons.
Otherwise, all that remains to say is that I wish you luck in your endeavours. This is meant to help you protect the copyrights to the pictures as well as protect Wikipedia, not to just throw a spanner in the works for the sheer heck of it. Dear Louise, I appreciate that you have taken a great amount of time and have given a lot of thought to this situation. As you cannot see the complete conversation which Theroadislong had with me I will paste what has been posted by Theroadislong on the Commons page "says that the source is Own work Author MildredJirak but the file name says it was taken by Evan Dunning and appears to be copyrighted/ http://www.schoodicsound.com/ Theroadislong (talk) 12:33, 15 February 2015 (UTC)" on his Talk page he asked me to prove my ownership of Schoodic Sound as the label is the copyright holder of the images. I have complete ownership of both images transferred to me, Deirdre McArdle, and my record label Schoodic Sound by Evan Duning and Christophe Buskewicz respectively. Both are friends and I listed their names as a courtesy as they were thrilled to have a place on Wikipedia which, in retrospect, was probably a mistake. Christophe's photo has been there for a couple of years actually. What should I do? Is this "disagreeing with a Volunteer Response Team edit" on the Talk page? I am not sure how to do this the right way. Thanks so much for all your help! Hello, Deirdre. That takes care of the copyright issue, which would need to be verified, and you've started that process. That takes care of point (a). We still need to make sure you're comfortable with (b). Are you happy to release the photographs under a licence which allows public re-use? If you are, that's totally fine. I am just a regular editor here on Wikipedia, so you're not disagreeing with me. If you get the images verified as belonging to yourself by the OTRS team that will show up on the Commons page. However, we just need to establish that you want to release the images under the licences that Commons supports - that is, the permission to allow anyone to reuse them, which comes along with them being on Commons. (There's no way on Commons to release photographs under e.g. an 'Only for Wikipedia', 'No derivatives' or 'Non-commercial' licence; it has to be released so people can use the images commercially - e.g. in a book for sale on Amazon - and make derivative works from them - e.g. using them as cover art or in photomontages.)
