Speedy deletion of MESA International[edit]

A tag has been placed on MESA International requesting that it be speedily deleted from Wikipedia. This has been done under section G12 of the criteria for speedy deletion, because the article appears to be a blatant copyright infringement. For legal reasons, we cannot accept copyrighted text or images borrowed from other web sites or printed material, and as a consequence, your addition will most likely be deleted. You may use external websites as a source of information, but not as a source of sentences. This part is crucial: say it in your own words.

If the external website belongs to you, and you want to allow Wikipedia to use the text — which means allowing other people to modify it — then you must include on the external site the statement "I, (name), am the author of this article, (article name), and I release its content under the terms of the GNU Free Documentation License, Version 1.2 and later." The image is now being used in the intended article, so I have deleted the deletion template that you placed in its description. As a separate issue, I am assuming that someone other than I, and who is a patroller/admin is going to check the fair use rationale and add the relevant template parameter. Do you know when this may happen? I have spotted an image that has been uploaded almost a year ago that has still not been checked.My Gussie (talk) 21:12, 31 July 2014 (UTC)[reply]
I don't know of anyone who is checking files without that parameter. I have now added it to this file. It is not a problem if the parameter isn't added to a file, as long as the fair use rationale is correct, so you don't need to worry about that. --Stefan2 (talk) 11:10, 1 August 2014 (UTC)[reply]

Local description pages for images that originate in Commons (e.g. Parm AG company logo)[edit]

I'm trying to learn about media files, trademark issues and company logos by using the specific case of the Parm AG company logo. From what I could figure out, the Parm company logo was uploaded to Commons by an employee of the company, who is also the copyright holder. This person has granted a share alike license for the use of the logo, so I would assume that there are no special considerations to be taken regarding copyright.

As far as the English Wikipedia goes, this logo is used for the company's article. A copy of the Commons file exists in the English Wikipedia, but I'm not sure how it got there. There is no local description page for this copy.

  • Should a reader see any trademark notices which only apply to the English Wikipedia?
  • If so, is a local description page the way to do this, and is the {{trademark}} template appropriate for this purpose?
  • If a local description page is created, must the whole copyright description from Commons be copied across?

As a separate, but related subject:

  • If a Category for use in the English Wikipedia needs to be added to the image, can this done in Commons, or must it be added to a local description page?

As far as I can tell, no local copy of that file exists. (And if it did, "also exists on Commons" would be a criterion for immediate deletion.) As File:Parm Logo.png says, "This is a file from the Wikimedia Commons. Information from its description page there is shown below." Wikipedia will incorporate files uploaded to the Commons without the need for a local copy. Personally I have never encountered a Commons image with a local description and would think that all relevant information, both a note about trademark concerns and categories, should be added at the Commons. Thanks for your help - I incorrectly assumed that there was a local copy of the file just because the url references Wikipedia instead of Commons. I was hoping that I could get a little more of your attention. On the image page there is a link Add local description that will create the page, so I'd be surprised if there aren't many images with such pages. Considering that copyright and trademark policies are different between the different languages of the Wikipedia, would one still put the trademark notice on the Commons page which by default appears to readers of all languages?My Gussie (talk) 21:24, 7 August 2014 (UTC)[reply]
I'm aware that it's possible to add a local description, but as I said, I've never seen it done. You may want to ask at Wikipedia talk:WikiProject Images and Media for a more informed opinion. Commons:Template:Trademarked is a general disclaimer that the image may be subject to trademark law in some jurisdictions and that users should check that their intended use is okay. Using that template once seems preferable to finding all local Wikipedias where the image may be subject to trademark restrictions and adding local disclaimers to all of them. Besides, the English Wikipedia alone is used by people from many countries with widely differing trademark laws; re-use of the image would still depend on local jurisdictions, not on the laws relevant to the English Wikipedia itself. As an aside, it could be argued that this particular logo is in the public domain because it doesn't meet the threshold of originality. Trademark law would still apply, of course.
