Matter of doubt..

Check The Alpha Complex. I marked it as "Unsourced BLP" and proposed for deletion, the creator removed the tag and added unreliable/primary source to the article. Also left a note on my talk page. I used about 2 tags for deletion but I had to revert myself. Because there is identification as well as BLP is sourced. I cannot add "promotion" tag, it can be reverted by other editor with the reason that "it is not advertisement".

Image consent and proof of permission

Good day,

I have re-uploaded an image which was deleted, namely File:Pie-Pacifique with Nelson Mandela, 2006.jpg. The copyright holder was not willing to give consent to Creative Commons stating they did not agree with such statements as "...I grant anyone the right to use the work in a commercial product or otherwise..." and "I am aware that this agreement is not limited to Wikipedia or related sites." but rather sent me the following email:

"This is to confirm that The Mandela Rhodes Foundation is the sole owner of the exclusive copyright of the image of Pie-Pacifique Kabalira-Uwase and Nelson Mandela and agrees to its use for the sole purpose of illustrating an entry about Mr Kabalira-Uwase on the Wikipedia website. This usage is conditional on the image being credited as follows: PICTURE COURTESY COPYRIGHT OF THE MANDELA RHODES FOUNDATION"

Following this, I then re-uploaded the image under the Non-free promotional and Non-free with permission tags. My problem now comes with the Declaration of consent email which should be sent to permissions-commons@wikimedia.org, I cannot find an email template for the stated tags for the copyright holder to send. Does such a template exist or is the above extract enough to be used as proof of permission?

Wikipedia is primarily concerned with providing free data and images. We do allows a limited use of non-free images under the US fair use policy. If they won't release it for free - then the only option is non-free - then it really does not matter what they say - at the end of the day it will have to comply with WP:NFCC just like any other non-free image so will need to be be small, low res, have a WP:FURG and appropriate non-free license. The tags on the page look OK - I've removed the "replaceable" message - since the subject is deceased - it is not replaceable - and adjusted the replaceability section to show he is deceased. It's a bit big - the non-free image bot will sort that out for you.  Ronhjones  (Talk) 19:17, 2 June 2014 (UTC)
Could you follow-up to my comment on that user's talkpage? I agree that a photo of this meeting (or anything else involving Mandela) is not replaceable because that person is deceased. But I disagree (and based my tagging) on the use-case or encyclopediac value with respect to the other person, who seems to be alive. DMacks (talk) 19:23, 2 June 2014 (UTC)

TeamCity was proposed for deletion by User:RHaworth on the 26 May 2014 (reason = no evidence of notability) - no one objected to the proposal, and no edits were done on the article to improve it. It was therefore deleted 7 days later. If you wish to object to the deletion then you can, and the article will be restored as a "contested PROD" - but do realise that unless the article is quickly improved to satisfy the requirements to stay, it will more than likely be put through the full deletion process.  Ronhjones  (Talk) 19:00, 4 June 2014 (UTC)

Re Bairnsdale Water Tower Photos

Hello,

Regarding the article on Bairnsdale with the picture showing the water tower that's in question. There aren't freely available pics that I can access or know of. I did have the permission of the photos creator to use it but given the fairly lengthy process that it would take to "officially" get his permission to the satisfaction of the rules set out by Wikipedia Admin, I think I'll just take a photo myself. Correct - if it's possible to go there, and take a photo then that makes it "replaceable". Or as you say you can wade through the WP:DCM process to get the permission. Marnie Blewitt fair Use Rationale

Hello and thank you for bringing the File:Marnie Blewitt.jpg fair use rationale to my attention. I uploaded this file yesterday in order to illustrate the article with the same name, as I could find no free copy of this person's photograph and because the picture was a thumbnail of a larger picture and I did not think that this would damage the rights of the copyright holder. If you could advise me whether this is justified or whether I am missing something I would greatly appreciate it. Thank you in advance for your kind assistance. If the person is alive (and not locked up) then the image is "replaceable". Thus it fails WP:NFCC#1 "Non-free content is used only where no free equivalent is available, or could be created" - One just has to find the person and take a photo. I was relying on the fact that printed along the bottom of the front page of this old theatre programme it says "To save paper please share this programme as widely as possible". The 'paper' bit refers to wartime economy. It is a 1943 programme. The 4 people photographed are all dead. The company they worked for ceased to exist in 1953. The theatre that produced the programme was demolished long ago.

Please advise further. I am new to authoring on Wikipedia.

You will find images are a minefield. Copyright in UK (I'm here) lasts for 70 years after the photographer's death - subject dying, firm out of business, etc. have no effect. If it can be shown that the photographer is truly unknown then it's 70 years post publication - which might make it OK for this year - hence the use of a WP:PUF as I'm not 100% certain if it's out of copyright or not. Thank you. So are Wikipedia's systems for dealing with them! I believe I have understood that:-

1. You have added it to the PUF list.
2. I could have done that myself if I was unsure of it.
3. After a week I will hear something, from somebody.
4. UTC means GMT. I wonder what's wrong with GMT.
5. I should have signed my message with 4 squiggles.

The photos are unattributed. I have already written to the son of the founder/director of the company which employed these dancers (the woman on the first photo) and await his reply. Almost certainly the company would have held the copyright of photos of its dancers used for publicity purposes, and almost certainly the woman inherited the company's assets when it ceased operations, and almost certainly the son inherited from his mother.

Re: File permission problem with File:Velocite Bikes logo.gif

I do not understand what the problem is and what I can do to rectify it. It is our company logo.

I followed the information links that you provided and I think I understood some of it - I am not a legal or copyright expert so a lot of the information is largely incomprehensible to me. Nevertheless... If I add a tag to the Velocite Bikes wikipedia page the tag adds a huge amount of text screwing up the formatting of the page or the info box. I also checked the Velocite Bikes logo.gif file information page and it all looks fine and fair to me. It is indeed a company logo, yes it is subject to copyright, no it cannot be modified, altered, remixed or misused.

Please help me to fix whatever the copyright problem is as I do not know.

He Ron, you tagged this image File:Deckmyn as lambic.png as not sufficiently low quality to be fair use, but wonder what you based it on. Is it mere file size? The file size itself is not in the editorial standard (just that it should be low res, which I think it is; especially compared to the original).

Theo's Little Bot would have uploaded an image which will be constant with the guideline at WP:Image resolution, so it's trying to get as close to 100,000 pixels as possible. The bot won't reduce an image that is small enough already.  Ronhjones  (Talk) 19:00, 5 June 2014 (UTC)

I said too big, I did not mention quality - the image is well bigger than the guideline. The reduced version is similar enough be OK. Photo of the side of a building in Boston

Hello. I took a photo of the side of a building in Andrew Square in Boston, Massachusetts, where there was a mural painted with no attribution. I am the author of the photo. I didn't paint the mural. There is no information I saw at the residential building about who painted the mural. Or maybe it was graffiti on the wall of a building. I uploaded the photo I took and added it into the article on the Andrew (MBTA station). The image in the English Wikipedia is File:Mural near Andrew Square Boston 06032014,jpg.jpg. You, a WP sys admin User:Ronhjones, flagged it as an image with no permission and speedy deletion. Here is your edit:

I made the photo. I gave permission. The people who painted it are not identified near the building as far as I could tell. Can you advise me or even fix this? Video copyrights - seeking your advice

Hi Ron. I'm working off-line on a draft BabyFirst article where I have a COI. There is an awful lot of source material[1] that tries to describe the content of their television channel for babies using text and it would be way better to actually show users a 5-minute clip, but all of their channel's content is going to be copyrighted with no free alternatives. Is there a non-free exception for this kind of thing? And where do I go to find out more about how to get a video uploaded? CorporateM (Talk) 22:49, 2 June 2014 (UTC)

OK - As I remember it all (video is still low use here)
  1. Non free video and audio clips - 30 seconds is regarded as maximum time (although I have seen a little longer - but that might be risky). As with all non-free you will need a WP:FURG and a {{Non-free video sample}} to go with it. As it's non free it will need to be uploaded on en-wiki - just upload as you would an image - but in the correct format (see below)! Check out Special:WhatLinksHere/Template:Non-free_video_sample for other non-free videos.
  2. Wikipedia:Videos for info on video formats - it has to be ogg (or ogv) format. There are some ways described to get that - Personally I've used MediaCoder (http://www.mediacoderhq.com/ - as I have it already) to do it (Theora Video; Vorbis Audio; OGG container - good converter, maybe not the most user friendly, but very powerful). The only one I have done of any size, you will find at Arnside. Note there are 2 versions - not sure what is recommended now, but as far as I know Wikipedia cannot scale a video like it does with a picture, thus there are two versions as described in the caption of the video link. This was to allow users with a slower connection to see the video and those with a fast connection to view a much bigger image. For a non-free, you will probably have to keep to a small image.

One of our class assignments for digital information was to discover a prominent New Orleans writer, artist, or musician who did not have a Wikipedia page, and to create one. In this way we learn about collective knowledge and how to be good users of the internet and also to share our local culture with the wider world. Ally Burguieres is a popular artist here in New Orleans and I created a page to share information about who she is for those who may be wondering. I am proud of my page and went to show it to my mom and was embarrassed to see it deleted as a "fluff piece". Thank you for commenting on an image that I am using in an article. The crux of the matter is that there seems to be no Wikipedia copyright template that seems applicable to photographs of boxes for commercial products.

All the Wikipedia copyright templates address publications and photographs of possibly copyrighted works such as art, sculpture, recognizable people, and possibly even certain buildings. The closest applicability would be the templates regarding book, album, and video covers, but a software box is not really comparable because it is not based on a single dominant graphic, but on trademarks to possibly include the box itself (as in a Tide box or Campbell's soup can - uh, Warhol?). But even photos of graphics are fair use if they are not of sufficient resolution for re-use. I believe that trademark protocols are appropriate and they are observed in the image and its use in my article.

In summary, I can't understand a non-free copyright of an image of a box for a commercial product, when used honoring trademark protocols. Packaging of a mass-produced commercial product is not a publication in the same sense as an album cover, I would think. If I am wrong, please let me know. I do have an inquiry for permission that we can use in the event that I am wrong on this. I have a longer reply on my talk page. Either my copyright understanding will be significantly enhanced in this discussion, or we may identify the need for yet another copyright fair use template for Wikipedia. Or, perhaps both!

Please DO get back with me about your opinion on whether boxes of commercial products are to be treated, legally, as publications, or as trademarks. -motorfingers- (talk) 03:46, 5 June 2014 (UTC)

Choices...
  1. As a free image - the only license I think possible is {{PD-US-1989}} - but only if the statement on that template is correct - if it had copyright on issue, then you cannot use that. If you do use that template then also add {{Trademark}}.
  2. As a non-free image - can you satisfy the criteria at WP:NFCC? If so you need
A) A WP:FURG, properly filled in.
B) {{Non-free product cover}}
C) You do not need the tradmark template - that's only needed on free images.
D) It's a bit too big for non-free - add {{non-free reduce}} to let the auto bot sort out the correct size.

Yes, you focused on the proper issues as I see them and pointed out the proper templates and policies for me, and I thank you very much for that. {{PD-US-1989}} does look promising as Absoft assures me that there is no copyright notice on the box itself; if I hear back next week that there is no copyright, I will use that and we are done. In the event of any uncertainty about what might have been filed I will pursue a fair-use template. That uncertainty is why I did not use {{PD-US-1989}} to begin with.
The non-free product cover template does seem to be close to what we have here, and it is something that I did not turn up on my own. I'll research all the policies that you suggest and the examples and apply the best fit. Reduction is not an option because the main point, other than documenting that Microsoft had Absoft write the Fortran (and BASIC) compilers for Macinstosh in 1985 is the note that Absoft wrote the compiler, which is in barely visible small print on the bottom of the back of the box. -motorfingers- (talk) 22:44, 7 June 2014 (UTC)

Spectrum of Green Bean Galaxy J2240

Hi. I uploaded the image File:Spectrum_of_Green_Bean_Galaxy_J2240.jpg to Green Bean Galaxies on the 4th of June. As it is a copyrighted image from the Astrophysical journal, I presumed that a 'non-free use' license would be ok, as the image is not freely available anywhere else. The full details are explained in the image's page. According to the history, the image was tagged and then reduced, perhaps waiting for a non-free use rationale. I've since provided a rationale, but really don't want my original upload deleted. The small size of the current image leaves it pretty unreadable.

As I've provided a rationale, maybe you could view it and decide one way or the other before the original gets deleted? The deadline seems to the 12th. Thanks, Richard Nowell (talk) 12:27, 8 June 2014 (UTC)

The non-free system does not give one a right to use any image at any size because it's unobtainable - all that is likely to do is to get a takedown notice from the copyright holder. The non-free image is supposed to give the user a flavour of the image, not be used for examining each nuance is high resolution. The guideline is to be about 100,000 pixels and low resolution. It is sometimes possible to claim a slightly bigger image where (for example) some small important item has been completely lost in the reduction - but I don't see that here. If one zooms in the image, the X scale is just readable enough to be used with any text you wish to use with the image. Your best way forward ia to get the copyright holder to release a free image at a bigger size and/or higher resolution and run that through the WP:DCM process.  Ronhjones  (Talk) 16:23, 8 June 2014 (UTC)

Taking a photo of an existing image does not transfer the copyright of that image to yourself, it's just a derivative of the original image - you need to find the date, country and thereby the copyright status of the original image (we cannot do that for you). It may well be that the original images are now public domain, but they need to have the correct PD license (WP:ICT/PD) and the original source before they can possibly remain.
You need to do the same with
AND
Could well be disputed as {{own}} unless you are claiming a camera on tripod with a delayed shutter - if so, you should say so. Remember copyright goes to the photographer, not the subject, unless there is a full signed release.  Ronhjones  (Talk) 19:08, 10 June 2014 (UTC)

The Alice Cooper is an autographed photo that I received from working with him, the Reazar and Reazett ontop of hollywood hills was taken by my iphone. Hall and Oates was taken from my camera but we just made it look nice like that for presentation. Tricky - if any image is published before the Wikipedia upload, it always creates issues. If you are in the image, then there's more issues as (unless you have very long arms, you may not have pressed the shutter)
Alice Cooper photo - copyright belongs to Alice or his photographer
Hall and Oates - may be your camera (irrelevant) - who took it?
the Reazar and Reazett ontop of hollywood - again who took it?

Gooday Ron. I recently found some airmiles (replica 'banknotes', cheque-size vouchers measuring 15 x 7 cms) under the paper liner in a drawer - I bought a suit from Burton, I think in 1989! I thought I would add an image in the UK section (there is no such image on Commons or on the Wikipedia article). These would better-illustrate exactly what Air Miles were, as there is vagueness presently, and also establish the correct form of the company name, which is mis-quoted.

The brand is quoted as defunct in UK since 2011, but the article already has two logos, one with , one having ®. The vouchers I have are for 10 Air Miles (x2) and are very 'busy' with the flying boat logo (with floats, as seen on the Registered logo), several fonts, art - a Globe, 2 mini-logos with 0.001 p per mile, the correct company name and an 11 digit sequential number. On the obverse are T&C.

I anticipated a .jpg rendering showing both sides. Could you forsee any difficulties, as they are much-more than a logo, and would it need to be non-Commons under non-free? Thx, Steve.--Rocknrollmancer (talk) 22:31, 9 June 2014 (UTC)

Definitely non-free on en-wiki. Why not make a composite image (front and back) one above the other = an image of 15cm x 14cm, then reduce that to about 330 pixels wide (and just over 310 high) - that should be good enough to view and keep nicely to non-free guidelines. I usually watch PRODs at Wikipedia:WikiProject India/Article alerts and somehow this was transcluded yesterday itself and I couldn't glance the article. This popped up on my watchlist. I think I might have been the creator, few years back. If this is the case, I wasn't notified on my talk of the prod, and as such I feel that I might have wanted to deprod this if I was made ware of it (I have over 5k items on my watchlist and can occasionally miss a prod notice or such). For the record, I had no intention on violating any requirement or not observing it. I could swear that when I consulted the page history to look for the creator that I found a "Retired" banner on the userpage. It could be that I had more than one user page open at the time and mixed it up. My apologies to @Piotrus: for my lapse. It would be good if this could be done automatically to avoid these incidents. I know of Twinkle, have never used it and I believe you need certain privilege level to be allowed to use it - I could be wrong. Although I would probably have preferred the old fashioned common courtesy of leaving a personal note. So, like I said, it was a lapse. You do not need any special privileges for WP:TWINKLE. I recommend downloading it; it's a fantastic tool which speeds up many mundane tasks like notifying uploaders. The standard answer I always give is that WP:COI editing is strongly discouraged - the relevant paragraph is COI editing is strongly discouraged. COI editors causing disruption may be blocked. Editors with COIs who wish to edit responsibly are strongly encouraged to follow Wikipedia policies and best practices scrupulously. They are also encouraged to disclose their interest on their user pages and on the talk page of the article in question, and to request the views of other editors. If you have a conflict of interest, any changes you would like to propose that might be seen as non-neutral should be suggested on the relevant talk page or noticeboard.. So, in theory you can edit, but most editors don't like it, and it has to be done extremely carefully. The recommended route is to use paragraph 2 of Wikipedia:Contact us - Subjects. You may recall me from Wikipedia:Files_for_deletion/2014_June_4#File:WugTest_NowThereIsAnotherOne_FairUseOnly.jpg. I do understand the importance of respecting copyright (being myself a consultant in intellectual property), but that goal is not served by robotic busybodies who don't know which end of the stick they've got hold of. An example would seem to Wikipedia:Possibly_unfree_files/2014_June_10#File:Rei-pub_neohantoni.png. A 200-year-old seal of a state of the United States is certainly PD, and a deletion "discussion" with but one participant isn't a discussion. A note on the talk pages of articles using the proposed-to-be-deleted file might be a smart idea. Could you please restore the file, and have a word with Mr. Stefan2? If I restored it, Stefan2 would be there real quick. Since I didn't delete it, it would be best to talk to the deleting admin at User talk:TLSuda - the problem is that it has the wrong license - you had this text This image is ineligible for copyright and therefore is in the public domain, because it consists entirely of information that is common property and contains no original authorship - there's a shed load of original authorship in that image. You need to pick the correct one from WP:ICT/PD - {{PD-old}} might apply - did the creator die before 1913? - otherwise it could be {{PD-US}} - it's up to the uploader to do the research and decide on the correct license. {{PD-ineligible}} was not the correct one to use here.  Ronhjones  (Talk) 20:27, 18 June 2014 (UTC)

This can only be done following one of the two methods at WP:DCM - either show permission on the web site, or send to OTRS. Permission will need to be at least CC-BY-SA. There is currently an issue with OTRS searching in that we cannot search for a url. However I did find just two letters from yourself

As I said, we cannot accept images "for Wikipedia use only" - The license needs to be at least cc-by-sa-3.0 - but we need the release to come from the copyright holder - not yourself. This is usually the actual photographer who will own the copyright, unless the photographer has explicitly released in writing.
Do note that we will need a release for each photo you intend to use - they can all be listed on one e-mail, but must be fully listed by individual file names. There is no way these images can be on Wikipedia until the release has been given.  Ronhjones  (Talk) 20:09, 23 June 2014 (UTC)

Aloha as we say here in Hawaii. I was looking up a very very famous actor- John Philbin- that apparently you decided because YOU don't know too much about him to delete his Wikipedia page! He is a semi-legend in the surfing world. Because of his staring role in the most famous of ALL Hollywood surfing based movies - North Shore which 80% off the 30 million + surfers around the world know of and quote on a daily bases. John Philbin! It was noted it was deleted because he didn't have more than one significant role??? go to IMDb, watch the movie Point Break- one of Americas favorites, where he was one of the main "bad" guys. Or the very important and a big time favorite American motion picture - Tomb Stone- again not just an extra but plays one of the main "bad guys", a character that is in the entire movie... He's had so many roles and again is known by 100% of everyone involved in the multi-billion dollar a year surf industry- the CEO's, the fans, the Pros etc... And also super well known the Movie industry in the USA. .. Anyways, His page in no way shape or form deserved to be deleted. I believe you deleted it right? So if you did you must please put it back up. He is a well known actor and has had over 50 rolls. Big and small- everything.. Point Break with Patrick Swayze and Keanu Reeves and Garey Busey! Just look at IMDb please. Seriously I can't believe you deleted it when you obviously don't know enough about him or these films he has been in. No hard feeling's, I am just blown away that an american actor that is so well known here in the USA is not on Wikipedia... It has been my observation that the leading editor (prior to Technical 13) has a very unique way of interperting WP policy, rules, guidelines, practices, and consensus. I have little doubt that the editor's goal is to get this furvor over their behavior to die down and then do a round of WP:FORUMSHOPing to get the answer they want.   • I don't think it should be userfied to my user space at all. It is a collaborative effort and as such it should stay in draft space at this point. To do anything otherwise would imply that someone indeed OWNs the article. As I said above from my mobile phone when I was a bit soberer (I suppose that's a real word since my spell check isn't yellin' at me, although it sounds funny when you say it), it is in draft space, not article space, and letting the MfD run its course isn't going to kill anyone, and if I manage to cite even one or two more things to a reliable source and strip everything that is not citeable out and make a stub out of it, even better. I might suggest that it be moved to Draft:Remote fueling as that would be a more appropriate final destination (more of a layman's term so it isn't overly technical), and I can obviously do that myself, but I'll discuss it with the other editors interested in the draft on the draft's talk page first. While I'm here on your talk page Ron, I'm noticing that you have some font tags in your signature. I'm fairly confused why they are there as they don't seem to be doing much of anything. I've been going around to a few user's I've noticed with similar oddities in their signatures because as you may or may not be aware, thos tags are obsolete and we are warned not to use them by the things like MDN (there's a whole discussion on these tags on VPR if you are interested in learning more. Apologies for my late reply to your earlier response and thank you for your help and your immediate attention. The vast majority of IP edits in Olympiacos BC are disruptive and unconstructive. There are many cases of blatant vandalism (combined with swearing): [2], [3], [4], [5] (and goes on and on). Moreover, if you look at the rest of the recent edits, you'll find out that the main purpose of almost every IP editor is to become the team's head coach. They change the starting five, they make their desired transfers, they move players from one position to another. There isn't a shred of real contribution to the article or to wikipedia for that matter. Also wanted to suggest that from next time we shall simply go for Afd than prodding the article again. Prod tag is taken seriously, but not as seriously as Afd. A user is allowed to remove PROD tag, I agree that there should be a legible reason, but no one really investigates the removal of PROD tag unless the article is violating copyright. Please restore this file. It was nominated after an editor replaced with a new file, this was reverted on 27 June and reinstated where it remained in the article until an ip removed again on 30 June. It was not therefore unused for 7 days. I would also state that per the infobox guidance for infobox musical it should be the earliest possible production image. The one the ip is trying to promote is in fact not the earliest but the one from the latest production so the new image is incorrect, and the old one has been deleted.Blethering Scot 15:41, 3 July 2014 (UTC)

The message at OTRS is only 4 days old and is still in the queue - the OTRS pending notice had been in place on the image for more than 60 days. Simply put there is a choice...
  1. Add this code shown at http://creativecommons.org/choose/results-one?license_code=by-sa&jurisdiction=&version=3.0&lang=en to the web site the image is being shown - but the web site should be related (domain name...) to the copyright holder (usually the photographer
  2. Get the copyright holder to send in the form at WP:CONSENT to permissions@wikimedia.org, again from an e-mail domain that relates to the copyright holder.

The procedure is at WP:DCM - if it's never been published elsewhere then the need to have an associated domain address does not, of course, apply. Professional or not makes not difference and full copyright rights are granted as soon as the person presses the shutter - for 70 years post the photographer's death. The file page said Source = www.oscn.net (Oklahoma Supreme Court website). The only license I can find on that site is on http://www.oscn.net/applications/oscn/SimpleHelp.asp?HelpContextID=84 - © 1997-2014 by The Oklahoma Supreme Court Network. All Rights Reserved. . That makes it unsuitable for inclusion on Wikipedia. The file page did have an {{OTRS pending}} notice attached, but no one in the last 60 days has got the permission approved at OTRS. You must realise that all editors are effectively anonymous and we have no way within Wikipedia of proving who you are. Thus we have a procedure to donate the copyright of the image so that it can be used here. The details are explained at WP:DCM. I can restore it as a contested PROD - no problem. I would suggest that it be restored as a user's sub page - otherwise there is a chance that it could be put up for a full deletion (WP:AfD}. So your choice.
  1. Plain restore
  2. Restore to a user sub page.
