@Derekguthrie, you've got this photo marked as your own work? It appears to be the Barry Marsden image in the National Gallery. Am I mistaking something here?

Hello Valereee. The photo is indeed the (well known) Barry Marsden mage you cite. I have no idea why it was credited to me (my mistake I guess). Apologies. Can it still be used?

@Derekguthrie, it was credited to you because when you uploaded it, you must have checked the box that said it was your own work. You should only check that box when you are uploading a photo that actually was taken by you personally. If you check the other box (not my own work), it'll ask you some other questions designed to help you figure out if it's kosher for you to be uploading it. For instance, if the image was from before 1927, it's in the public domain, and you can upload it. There are also fair-use reasons you can upload some images -- like the logo of an organization, or an image of someone who is no longer alive.
Little is still alive, which means someone can take a photo of him and upload it, so we can't consider this a fair-use image of him. I'm no expert on copyright, but it looks like the National Portrait Gallery's policy restricts use of images, so it's not a free-use policy. That definitely means it shouldn't be on Commons, and I think that means we can't use it here except for fair-use, which this is not. @valereee This was certainly my error. Although I'm a novice when it comes to the architecture of Wiki , I do have experience in copyright and know not to use anything uncredited or wrongly credited. I can't remember exactly but given that this is such a well known portrait I thought I had uploaded it under 'fair use' and written an appropriate credit of what the picture is and more importantly where it's from/who the copyright owner is. Obviously. I've done something wrong somewhere and you are correct. It should not be there.

@Derekguthrie, FWIW, I've had good luck with simply emailing the person and asking them to upload a selfie to Commons. People are generally motivated to provide a photo they don't hate. :) valereee (talk) 19:42, 29 May 2022 (UTC)[reply]
