Mojo Workout

There should be some mention of the variant version known as Mojo Workout, which was recorded by a number of artists including Bill Cosby (in his 1960s album Bill Cosby Sings). 68.146.70.124 (talk) 04:50, 31 January 2014 (UTC)[reply]

The case of Strachborneo v. Arc Music 357 F. Supp 1393 (S.D.N.Y. 1973), mentioned in the article, states at footnote 10: "Defendant Preston Foster, also known as Red Foster, attended parts of the trial. A Black man, about forty years of age, he appeared with bleached blonde hair and highly modish clothing. He sat quietly in the courtroom and did not, in my presence, communicate with counsel for either party. His presence was known to both parties, and neither counsel chose to call him as a witness. The Court is now asked to infer from defendants' failure to call Foster to testify, that his 1957 copyright did not in fact represent his own original work, and that he could not so testify. No reasonable basis exists for reaching such an inference, and the Court declines to do so. Foster's testimony was not required where plaintiff failed to establish copying by defendant."
