I've been sent an email that this entry might be deleted because it is consider by whoever sent the message to be a dictionary entry and not an encyclopedia entry. In fact, the issue of Implicit Divestiture is the most critical judicial issue facing the Native American tribes of the United States at this time, because it puts the question of indigenous sovereignty outside its traditional protections in the United States Constitution and the 19th century Supreme Court decisions called the Marshall Trilogy, and within the power of the current Supreme Court. This effects, I believe, in the long run, the territories of the United States as well.
