Kenneth Cole Productions claims to have been "bilked" out if in excess of $1.1 million ![edit]

On January 19, 2010, Kenneth Cole Productions, through and by its attorneys, has filed a Complaint and Jury Demand against multiple Defendants in an action which it claims: 1- "arises from a civil conspiracy between and among the Defendants under which Defendants, pursuant to a pattern of coordinated and unlawful activity, knowingly and intentionally bilked KCP out if in excess of $1.1 million by billing KCP for pickup and delivery services that KCP never requested and that none of the Defendants ever provided in connection with more than 10,800 shipments over the course of approximately six years. 2- Defendants conspired to induce KCP to pay for the phantom shipments by using fictitious manifests, forged signatures, doctored bills of lading and false and fraudulent invoices that they issued to KCP. 3- In this action, KCP seeks to recover from the Defendants the amounts the Defendants fraudulently took from KCP, plus punitive damages, attorneys' fees and costs as well as statutory damages and penalties under, inter alia, the Consumer Fraud Act, N.J.S.A. 56:8-1 et seq., and the New Jersey 'RICO" statute, N.J.S.A. 2C:41-2 et seq." —Preceding unsigned comment added by AwOLonline (talkcontribs) 19:44, 23 January 2010 (UTC)[reply]
