"In a decision rejecting a motion to dismiss the claim"

I edited to specify which claim the district court decided not to dismiss: "In a decision rejecting a motion to dismiss the misrepresentation claim..." I'm not a lawyer, but in retrospect I guess the only part the court was deciding was the claim of misrepresentation, and not the DMCA "claim" that started it all, and I also realize that a DMCA claim is probably not considered the same sort of claim. But, it threw me off on first read so I fixed it. Advance apologies if I guessed the wrong "claim" that the court decided to reject the dismissal of.
