Dr.Bertzel beim Amtsgericht Landau - Zweigstelle Bad Bergzabern - angeregt, ihn zum Pfleger des Deutschen Reiches hinsichtlich der Eigentumsansprüche auf die Grundstücke im Mundatwaldterritorium zu bestellen. Da das Mundatwaldgebiet zum Zeitpunkt des Inkrafttretens des Grundgesetzes am 24. Mai 1949 aus dem Gebiet des Landes Rheinland-Pfalz und der Französischen Besatzungszone ausgegliedert gewesen sei, komme Art.134 Abs.1 GG nicht zur Anwendung. Deshalb seien die Grundstücke im Eigentum des fortbestehenden Deutschen Reiches geblieben ... Mit der Aufhebung der Verordnung Nr.212 sei der Mundatwald weder Bundesgebiet geworden noch gelte das Grundgesetz dort. Vielmehr gelte die Rechtslage, wie sie am 23. April 1949 gegolten habe.

Mai 1988 hat das Amtsgericht Landau in der Pfalz - Zweigstelle Bad Bergzabern - "wegen der bestehenden Ungewißheit der Beteiligten für die Wahrnehmung etwaiger bürgerlichrechtlicher Ansprüche oder Rechte des Fiskus des Deutschen Reiches bezogen auf den Grundbesitz im Mundatwaldterritorium" eine Pflegschaft errichtet und zum Pfleger den Notar a.D. Dr.Bertzel bestellt. Eine weitergehende Begründung enthält der amtsgerichtliche Beschluß nicht.

The Federal Republic of Germany of Germany claimed co-ownership of the estate against this appraisement. Therefore it was to be assumed that an uncertainty of law existed as to the beneficiary. Therefore there was a need for the appointment of a curator [claimed Bertzel].
In its decision of 4 May 1988 the Landau in Palatinate Local Court - Bad Bergzabern Branch - established a curatorship "because of the existing uncertainty of the involved [parties] for the protection of possible civil claims or rights of the treasury of the German Reich concerning the estate in the Mundat Forest territory" and appointed the retired notary Dr Bertzel as curator. The local court's does not contain a further rationale.
