Could someone explain why the court sentence was changed?[edit]

This presumably is due to the differences in South African laws, but for example here in the USA, the double jeopardy clause in the U.S. Constitution prevents such an action. Once the decision is delivered the State cannot appeal, unless there is something unusual like a miscarriage of justice (e.g., the presiding judge admits to taking a bribe to throw the case). Could someone include a note as to how and why the original decision was changed? __209.179.0.121 (talk) 17:23, 4 December 2015 (UTC)[reply]

The prosecutors appealed the verdict. Apparently that's the legal system works in SA. I added a couple of paragraphs on the process. Pkeets (talk) 01:47, 5 December 2015 (UTC)[reply]

Yes, prosecution appeal is possible in the UK, too, in exceptional circumstances. Note that the sentence is actually 15 years, the minimum for murder in South Africa, according to the BBC report, less time already served = 13y5m. — Preceding unsigned comment added by 81.174.131.198 (talk) 10:14, 24 November 2017 (UTC)[reply]

The responses to the original question explain how it could be changed - but not why.

The trial judge, having heard all the witnesses, concluded that Pistorius' statement that he thought the person in the bathroom was an intruder was truthful. A vulnerable person who shoots an unknown, possibly armed, intruder is committing a crime in some jurisdictions, but there are clearly mitigating circumstances. Influential media promoted the opinion that he just intended to murder Steenkamp. This created a lot of political pressure for a heavy sentence, which may, or may not, be the reason the Supreme Court kept overruling the trial judge. But this is really speculation and does not belong in the article. Longitude2 (talk) 22:03, 10 July 2020 (UTC)[reply]

Reeva Steenkamp[edit]

Steenkamps murder almost a footnote amongst many accolades. I’m not suggesting an alternative template but I do feel it’s an issue to consider. 2A01:4B00:87A0:1F00:8D9D:52C1:18F2:A34B (talk) 21:18, 23 December 2022 (UTC)[reply]

I would also expect his profile photo to be a mugshot, not a glamour sport photo. 2400:2411:1C1:C400:7928:847C:9B08:2CD2 (talk) 02:49, 18 January 2023 (UTC)[reply]

Developmental Disorders, impulsivity and Gods Law[edit]

Dear people,

The world speaks about killers, some may have an accident in pulling a trigger from fear and even before evaluating all the evidence in a scene. When this happens, the literature discusses it as impulsivity. It is part of a developmental disorder of childhood, or brain injury even.

Dr Micki may have addressed this hot topic somewhere in her books, or she may not have known about it?

Her relative Oscar Pistorius, it seems to me was a person whose life story indicated features of the disorder ADHD. At fractions of seconds- mentioned in the literature as p300, N200 and so on, some people’s brains do not process all the relevant information before action occurs. Action occurs before the brain can process all the relevant information. It is a disability they live with, with regret at impulsive actions , over and over. I hope this science will be considered for Oscar. As a society, we sometimes put behind bars those with disorders who cannot actually do any better in such situations of immense pressure. We collectively cause immense distress for those with disabilities, and their families. It’s like putting a lame person in prison because they cannot walk straight, because we don’t know about the type of disability. May he be exonerated, as a previously practicing clinical/ neuro Psychologist in Australia, I see the signs of this disorder in his life story. I hope some professional there will find it in their heart to go to his aid and the aid of his family for good. The law is only as informed as those practicing the sciences informs them.

May the pages reflect this as well so all can learn about the nature of brain functioning so he can be exonerated, and his parents who cared for , so well, and brought up an excellent child of God, who had a tattoo that he does not run aimlessly. Those with hyperactivity can run aimlessly. That scripture also was to guide his path. They do not strike with intent, but from emotions such as fear or anger, in that situation it was from fear. The other passage in the media, tattooed on his body was also to guide his path in life, for his enrichment and to believe in the promises of God, that Gods word brings healing to those parts of his life that were lacking. please consider these also as evidence that the prayers and guides in Gods word, tattooed on him were for those intentions and not as it may read to some. Psychology and spirituality are linked, one must know the context of both to read into matters of the mind. May this interpretation of reasons people Tatoo scripture on their bodies guide his judgement too, if possible. Psyche is mind.

mr Oscar”s upbringing indicates that he would have loved her no matter what. Arguments are part of the growing relationship, with the disorder it can be fiery, but that .sounded to me to be an impulsive act, understood by the sciences of impulsivity as an accident stemming from the disability.

Would you please pass this to Micki Pistorius, as forensic Psychology may not include in-depth study of the developmental disorders, and her nephew may be in jail for a want of scientific knowledge spreading to appropriate circles in law enforcement. She may be able to write about it for the world to know, so that we can forgive those who cannot walk straight when they are lame, and forgive those who cannot evaluate all the information in a situation before they act, from impulsivity. May God bless this for all, and may South Africa lead the way in the knowledge of this for the world to know and also to respect their wonderful athlete and his long suffering, his family, and his nation. He suffered for God, may he find peace and joy, respect deeper than before, and a new life of wonderful protection in South Africa. What a wonder he is!!! And his family!!! And his nation!!! He was their icon and an opportunity for leadership in this is for the good of all with that problem. May zSouth Africa lead the way for justice and mercy for all with that disability.
