Some actions constitute trespass and conversion; in these cases, a plaintiff must choose which claim to make based on what amount of damages they seek to recover.

Surely this isn't true: under federal and most state procedure, a plaintiff can plead multiple causes of action in the alternative. Why wouldn't this be the case with trespass and conversion? NTK (talk) 00:24, 7 October 2008 (UTC)[reply]
