McReynolds' participation?[edit]

This article claims that James C. McReynolds participated in the decision of this case. However, it seems generally agreed that McReynolds resigned his commission as Associate Justice on or about January 31, 1941, which would preclude his having either heard arguments or voted in this case. I'm removing his name, but if some contributor comes up with compelling evidence that he did in fact participate (I'm skeptical that any evidence would exist even if he somehow had; the practice of listing each Justice's participation and voting for each Supreme Court case is a relatively recent innovation, and I doubt any secondary sources exist to confirm or deny the participation of a Justice who, at the very least, did not write separately in the case.) I'm seeing now that this is a template problem...perhaps I should take it up on that talk page. Unfortunately, he participated in some of the cases for the period the template covers, but not others, having retired about halfway through the period. SS451 (talk) 20:06, 7 December 2007 (UTC)[reply]
