Kaplan wrote that he had worked as for over a decade for the CIA and State Department, where he had dealt with classified material.[2] He wrote that the CIA's assertion that it had to clear every document was extremely unusual. He wrote that some classified documents had a further restriction, called "ORCON", where the originating agency's permission was required if someone outside that agency wanted to forward it to another party -- even if the other party otherwise had the appropriate security clearance. But he challenged whether the CIA could claim authority to restrict the distribution of documents which had not been marked with an ORCON restriction. He challenged whether the CIA could claim authority to restrict the distibution of documents of documents that had not been created by the CIA. And he challenged the CIA's claim that it had the authority to restrict distribution outside the executive branch -- that executive branch documents were routinely distributed to those with the appropriate clearance in the judicial and legislative branches.

George M. Clarke III swore a declaration on 9 September 2008, stating that Toffiq's brother Adnan Al Bihani, serving as "next friend" initiated the habeas corpus process, in a letter dated 17 June 2005.[2] Clarke and other attorneys formally filed the petition on 14 December 2005. Toffiq had initially Toffiq declined to sign a form authoring Clarke to serve as his counsel in 2005. But when Clarke was able to meet with him on 28 March 2007 Toffiq verbally authorized him to serve as his counsel, and he followed up that verbal authorization with a letter authorizing him to serve as counsel.
George M. Clarke III swore a declaration on 9 September 2008, stating that Alkhadr Al Yafie had signed the forms authorizing counsel to represent him in habeas corpus petitions on 5 September 2005.[2] Clarke swore that Al Yafie had verbally authorized him to represent him on various visits, including one on 26 March 2007.
