They are an inherited line of descendants of the CherOCreek Indians. Some of the descendants/or future descendants have documented ancestry involving one or numerous treaty contracts with the Federal Government and are descendants of tribal royalty, some tribe members or members who are qualified to enroll are descendants of historical tribal chiefs. Not all descendants qualify for federal benefits but the tribe is providing some benefits on the tribes behalf, for all members who enroll with the tribe. When you become enrolled with the tribe you will be enrolled as one of the following, basic tribal citizenship, tribal council membership, tribal elder membership, or associate membership (this membership is for members who do not qualify for enrollment as a citizen). The tribe has joined in partnership to be a sponsor or supporter for Ocean Conservancy. The tribe has a vein of gold located on one of their reservation lots "this lot is located with in indian territory AZ", they include a few excavation sites, these lands consist of 2 lots purchased together measured at 60 feet by 130 feet each and are partially fenced.There are several dirt roads and partial roads running through the reservation lands, these lots also have a seasonal creek and a couple run offs. The tribe also holds in trust lands with a spring or creek and a dried pond attached to man made irrigation ways, (which may be put to use or preserved at any time), this lot is situated within their Wi. reservation lands. This lot measures 3.3 acres and has direct access to an all access public park and river which boasts historical features. The tribes Tx. reservation lands are a total size of 20 acres and are fenced near the Highway, there is currently 2 stock tanks close by (across the street), these lands are part of a community of an actively working Ranch "The Cornudas Ranch". These lands may be subject to change in the future or may not. Native American sovereignty and the Constitution
The United States Constitution specifically mentions the relationship between the United States federal government and Native American tribes three times:
Article I, Section 2, Clause 3 states that "Representatives and direct Taxes shall be apportioned among the several States ... excluding Indians not taxed."[2] According to Storey's Commentary on the US Constitution, "There were Indians, also, in several, and probably in most, of the states at that period, who were not treated as citizens, and yet, who did not form a part of independent communities or tribes, exercising general sovereignty and powers of government within the boundaries of the states." Article I, Section 8 of the Constitution states that “Congress shall have the power to regulate Commerce with foreign nations and among the several states, and with the Indian tribes”,[3] determining that Indian tribes were separate from the federal government, the states, and foreign nations;[4] and The Fourteenth Amendment, Section 2 amends the apportionment of representatives in Article I, Section 2 above.[5]
These basic provisions have been changed and/or clarified by various federal laws over the history of the United States. Regulate, historically means facilitate. Therefore, the Congress of these United States was to be the facilitator of commerce between the states and the tribes.[6]
These Constitutional provisions, and subsequent interpretations by the Supreme Court (see below) are today often summarized in three principles of U.S. Indian law:[7][8][9]
Territorial Sovereignty. Tribal authority on Indian land is organic and is not granted by the states in which Indian lands are located. Plenary Power Doctrine. Congress, and not the Executive Branch, has ultimate authority with regard to matters affecting the Indian tribes. Federal courts give greater deference to Congress on Indian matters than on other subjects. Trust Relationship. The federal government has a "duty to protect" the tribes, implying (courts have found) the necessary legislative and executive authorities to effect that duty.[10]
Tribal sovereignty in the United States
Tribal sovereignty in the United States is the inherent authority of indigenous tribes to govern themselves within the borders of the United States of America. The federal government recognizes tribal nations as "domestic dependent nations" and has established a number of laws attempting to clarify the relationship between the federal, state, and tribal governments. The Constitution[1] and later federal laws grant local sovereignty to tribal nations, but do not grant full sovereignty equivalent to that of foreign nations, hence the term "domestic dependent nations".
