Magazine covers[edit]

To be honest, pictures are not an area I deal with too often, so I'm not the best expert on "fair use". However, I don't see anything wrong with your cover on Terrell Owens (the fair use tag for magazine covers explains things well.) Different editors have different experience and opinions, so sometimes a few might disagree with you do on here while others find nothing wrong with it (at least until further discussion.) It's a part of the nature of Wikipedia. If someone keeps deleting your pictures, talk to them directly or bring it up on the article talk page. Grandmasterka 18:44, 19 April 2006 (UTC)[reply]

You might want to review this discussion regarding the "fair use" of magazine covers. My (limited) understanding is that they can only be used when discussing that particular issue of the magazine, but not as general images of a player. --mtz206 19:07, 19 April 2006 (UTC)[reply]

Greetings. I wanted to address what you said on my talk page, to try to better explain what I was trying to do:

They are fair use for pictures. A lot of the sports articles have them as pictures for the person being represented. So, therefore it is fair use.

I respectfully disagree; I'm basing this on the actual template for magazine covers, Template:Magazinecover, which states that fair use for a magazine cover means:

  • to illustrate the publication of the issue of the magazine in question

...which I do not believe is the same as 'to illustrate the person or event a magazine cover depicts'...like the difference between a Sports Illustrated cover being in the article for Sports Illustrated, versus Peyton Manning. Please see Wikipedia:Fair use (particularly, the counterexamples, example 6) if you'd like to know what I mean here...they're the reason I took the covers down in these articles.

Greetings...you wrote, They are fair use for pictures. A lot of the sports articles have them as pictures for the person being represented. So, therefore it is fair use. How is what I'm doing different than what anyone else is doing? I am just using them as pictures for the person. The same as everybody else.

What I (and several people here, if my estimation is correct) are trying to explain is that the use of magazine covers to portray sports figures is not legally valid as fair use and shouldn't be done. Just because many articles are doing this, doesn't mean it actually being done is the right thing to do, and is an invalid syllogism:

  • Fair use can be used to put pictures in some articles and
  • Many Wikipedia articles about sports have magazine covers claimed as fair use therefore
  • Using magazine covers to portray sports figures is fair use

...which isn't necessarily true based on the first two points.

Hello CubsFan. I have also undone your readdition of the SI cover to Donovan McNabb. It is true that there are magazine covers being misused as portraits throughout the encyclopedia. Hopefully, we will eventually remove them all, but in the meantime, please do not revert the edits of people trying to make headway on the problem without first discussing it with them. Concerning that fair use screenshot[edit]

The reason that I removed the image Dennis Rader 2.jpg from the biographical article about Dennis Rader is simple: as the {{Tv-screenshot}} says, it is - for identification and critical commentary on the station ID or program and its contents and can be used on the article on NBC, KSN or the program pictured, anything else is not fair use. I'm sorry, but you're going to have to explain to me why it needs a new start. Due to the GFDL license, we have to keep a record of who contributed what. That means we can't just delete people's contributions because we don't like them. If you tell me why you think it needs to be deleted, I might be able to help - but I can't do anything unless you explain your concerns. If you have not created this media yourself then there needs to be an argument why we have the right to use the media on Wikipedia (see copyright tagging below). If you have not created the media yourself then it needs to be specified where it was found, i.e., in most cases link to the website where it was taken from, and the terms of use for content from that page.

If the media also doesn't have a copyright tag then one should be added. If you created/took the picture, audio, or video then the {{GFDL-self}} tag can be used to release it under the GFDL. If you believe the media qualifies as fair use, consider reading fair use, and then use a tag such as {{Non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair_use. See Wikipedia:Image copyright tags for the full list of copyright tags that you can use.

If you have uploaded other media, consider checking that you have specified their source and copyright tagged them, too. Image copyright problem with Image:LeBron James.jpg[edit]

Thanks for uploading Image:LeBron James.jpg. However, the image may soon be deleted unless we can determine the copyright holder and copyright status. The Wikimedia Foundation is very careful about the images included in Wikipedia because of copyright law (see Wikipedia's Copyright policy).

The copyright holder is usually the creator, the creator's employer, or the last person who was transferred ownership rights. Copyright information on images is signified using copyright templates. The three basic license types on Wikipedia are open content, public domain, and fair use. Find the appropriate template in Wikipedia:Image copyright tags and place it on the image page like this: {{TemplateName}}.

Please signify the copyright information on any other images you have uploaded or will upload. Remember that images without this important information can be deleted by an administrator. Copyright problems[edit]

Alright, this is starting to get old. Please read WP:FAIR for a description of what is acceptable for images. (I don't deal with images much, but that was helpful for what I could and couldn't use.) Repeatedly pushing copyvio images or improperly tagged images on here is a good way to get yourself banned. Please stop. To add, images must include the source information. Just because you acknowledge that the image is copyrighted, that doesn't mean that the image can be uploaded. You can try looking for an image on Flickr instead. Inappropriate reversion[edit]

This reversion that you made to A. J. Hawk was totally inappropriate. It undid more than 25 constructive edits made over the past two weeks, presumably for the purpose sole purpose of restore the image Image:A.J. Hawk.jpg (which, by the way, is not a publicity photo). Please be more careful in the future.

I'd also like the echo the points made in the preceding topic. Please carefully read each of the following pages before uploading any additional copyrighted images:

Also, understand that goal of Wikipedia is to create a free content encyclopedia. As such, we strongly discourage the use of copyrighted images of any kind when there are free alternatives available. In the case of contemporary athletes — who perform in public on a daily or weekly basis — there is ample opportunity to produce or procure free images for the purpose of identification, and no excuse for using nonfree images from commercial sources. Final warning[edit]

Cubsfan, looking though your recent edits to verify that you have not contributed copyrighted text to articles other than the two listed above, I discovered that you have continued to upload copyrighted images, unsuitable for Wikipedia, despite many warnings. Because you have made some valuable contributions, I have not blocked you from editing, but you must not upload any additional copyvios. Aside from video game screenshots, it looks like few to none of the images that you have uploaded have been properly tagged. For example, {{promotional}} is for Wikipedia:Publicity photos from press kits (which may not exist for most athletes), and {{sportsposter}} is for promotional posters of events, not posters of athletes that are being sold like Image:Sean May.jpg. Just because an image depicts a certain individual does not grant us the right to use it under fair use.

More important than the tagging, however, is that Wikipedia is a free content encyclopedia, and allows copyrighted material in only a few particular circumstances. One of our criteria for the use of a copyrighted photo is that there must not be free alternatives available. This is not the case for any of the active, contemporary athletes that you have been uploading pictures of; they perform in public on a daily or weekly basis, providing adequate opportunity for free images to be produced. Part of the reason we do not allow copyrighted images in these cases is because their presence in the articles hides the need for free images, and decreases the chances that WP contributors will produce or procure free replacements. When a copyrighted image must be used, it should be accompanied by a rationale that makes clear the reason the image is needed in the article, the image's copyright holder, the reason the copyright holder is not being harmed by its use, and the reason why a free alternative is not possible.

Please read each of the following very carefully before uploading any additional copyrighted images, of any kind. Until then, please contribute only text that you have written yourself.

Yes, unlike Reggie Bush, there is no free alternative to a screenshot of Super Mario Brothers. You can use a small number of screenshots (preferably one), provided they are used in an article about the game. It does not matter whether the image promotes the game (in fact we try not to promote anything here on Wikipedia); what matters is that the image is critical to the written commentary about the game. ×Meegs 23:58, 14 May 2006 (UTC)[reply]

I notice the 'image' page specifies that the image is being used under fair use, but its use in Wikipedia articles fails our first fair use criterion in that it illustrates a subject for which a freely licensed image could reasonably be found or created. If you believe this image is not replaceable, please:

  1. Go to the image description page and edit it to add {{Replaceable fair use disputed}}, without deleting the original Replaceable fair use template.
  2. On the image discussion page, write the reason why this image is not replaceable at all.

Alternatively, you can also choose to replace the fair use image by finding a freely licensed image of its subject or by taking a picture of it yourself.
