Saw your question on the IRC #wikipedia-en-help channel.

Photo uploads can be tricky with respect to permissions and copyright. Ideally, the copyright holder (the photographer, or, perhaps the executor of their estate, is the copyright holder, not the subject or the subject's descendents) would upload the photo to Wikipedia Commons with the right sort of release and satisfy the admins there of their right to release it.
