Uploading copyrighted NPG images to Wikimedia Commons for use in Wikipedia

Hi January Today I sent a message to the talkpages of User DimSum38 regarding their uploads to Wikimedia Commons from the NPG. You will see that there are quite a number and there is a large area to dispute on them. As you can see from User talk:DimSum38 I offered to help. However, I have not had a reply and the user continues to add these images to wikipedia. Given that the user chose to delete an identical message I sent to their Commons talkpage, I conclude that this issue needs to be addressed by someone other than me. On the same theme, last year I also contacted Commons User BartBassist who has done likewise. This user seems to have claimed that the images are all PD because they are UK Govt images which they are not. This user did acknowledge my message but has not addressed the issue either. Given the volume of uploads concerned, I did not think that the best approach was for an individual user such as myself to dispute each one individually. If your involvement does not extend to Commons, perhaps you could alert someone there to the uploads of these two users. Graemp (talk) 17:29, 13 February 2014 (UTC)

I nominated most of DimSum38's uploads for deletion at Commons:Commons:Deletion requests/Files uploaded by DimSum38 (a few of them were public domain, although not for the reason claimed). BartBassist's uploads are mostly photographs by Walter Stoneman which other editors have also uploaded on the same basis, so I've raised the general issue at Commons:COM:VPC#PD-UKGov on photographs by Walter Stoneman and Howard Coster. Thanks, Re writing the content as per Wiki standards. OMICS Creations is producing around 6 films, each film budget is around fifty crores equivalent to US$65 Milion for six films as per box office reports of those films. OMICS Creations article is about movies and films and re-written as per WP, Please check carefully., until the review done by admin/copyright clerk we should restore the article instead of redirecting to scientific journals publishing OMICS Publishing Group as it is comes under meaningless redirection. Sean Harris

Sorry, but I do not understand the message. The photo was a part of a press kit promo to promote the film and made a part of a webkit available to press. I do not know how to tag it as "fair use", other than what I have done, because all it does is mess up the page it would appear on. Please, then, delete the pic.

I've deleted the image per your request. Even if you had tagged it as fair use, it would still have been deleted as images of living people are not normally considered acceptable fair use on Wikipedia, please see WP:NFC#UUI. January (talk) 19:00, 28 February 2014 (UTC)

Deleted Article: Molecular paleontology

Hi there, will you please elaborate on why the topic of Molecular paleontology was deleted today? I looked at the article on Molecular paleontology that you posted along with the deleltion, although I do not believe the phrase itself comes under copyright infringement. Papers with the phrase molecular paleontology are being published by several Universities from several countries around the world. I am planning on contributing to and improving this article, so please let me know if you believe there will be any issue with this.

Also, on a quick look it seemed to me the statement in Barnett's article that Barnett married Hilda "Ella" Frances Clement Forbes in 1889 is not mentioned anywhere in the ref currently cited. Copyright clearly says here http://pib.nic.in/newsite/terms.aspx that "....Material featured on this website may be reproduced free of charge and there is no need for any prior approval for using the content. ...." The site is the Press Information Bureau, Government of India and these images, I presume, are meant to be widely used. Dkflkc (talk) 22:26, 16 April 2014 (UTC)
Unfortunately the terms of that licence are not compatible with Wikimedia projects due to the requirement that the "material must be reproduced accurately", as part of the definition of free content is that it allows modification. Robin Cousins

That Template is not a duplicate. It's also on the page of most Olympic medalists , ex. John Curry, Scott Hamilton and Brian Boitano etc.. It's designed for making a direct display medal template shorter and leting users see Olympics medals at first glance without clicking. (The template can be set to show all medals, but that will take too much space and be too complex on the page layout.) hou26 15:08, 27 April 2014 (UTC)

Looking at the histories it seems to be the work of one editor who added templates to the infobox en masse to articles which already had separate templates for the Olympic medals. Perhaps I'm the first to question it but it seems a very odd practice to have two sets of templates showing the same thing, even if one is hidden by default. Just a personal preference, I usually only delete files that someone else has already tagged for deletion. That way two people have reviewed the file and agreed that it meets the speedy deletion criteria. There isn't any policy requirement for someone else to have tagged the file before it is deleted, but I think mistaken deletions are less likely that way. January (talk) 20:14, 18 May 2014 (UTC)

January, why was my image "File:Marisa_Lankester_2014.jpg" deleted when I uploaded it to Wiki Commons and received permission from the person to use it? The image was initially put under a different name as copyrighted, however, after receiving a deletion notice on it, I asked for permission to use it and give rights to Wiki Common. You don't seem to have any edits or uploads at Commons, so I assume you mean File:Marisa Lankester 2014.jpg which was uploaded locally as non-free. This is tagged for deletion as replaceable fair use since Wikipedia does not normally accept non-free images of living people, even with permission (please see WP:NFC#UUI). For Wikipedia to be able to use this or another similar image, the copyright holder (normally the photographer) will need to release it under a licence which allows unrestricted commercial use and modification. If they are happy to do so they should send an e-mail confirming this as per the instructions at WP:CONSENT. January (talk) 17:21, 6 June 2014 (UTC)

You uploaded it as your own work, if it was someone else's photo but you had permission this should have been specified when you uploaded it. However, deleted files can be restored so if you send evidence of permission to OTRS now they will restore it. January (talk) 17:03, 30 June 2014 (UTC)

The issue here seems to be with URAA. As I understand it images published before 1923 do not need the {{not-PD-US-URAA}} tag as the copyright term for images published before 1923 was 75 years after publication, which has already expired. URAA does not extend copyright, works copyrighted under URAA are subject to the normal US copyright term so if that term has expired the work is still public domain in the US. How to stop redirection and generate original article

Dear January,

When I was trying to create a page of Surojit Chatterjee, I found the keyword is redirected to his Band 'Bhoomi' but I think any one can create a page of an well known individual on Wikipedia. There I am very eager to know how I can stop that redirection and create a unique page with Surojit Chatterjee's information only. Instead of redirection to his band page can I create a unique page on his name. As I was unable to create article on that particular name. I change the article title to Surojit Chatterjee (Musician). The draft version (Draft:Surojit Chatterjee (Musician)) was declined because it was not sufficiently sourced. Wikipedia's verifiably policy requires information in the article to be cited to reliable sources (please see WP:RS). I see you have re-submitted it but the draft still has a lot of unsourced information, for example there are two awards in the lead which are not cited and further down there are two sections with no citations, so it may be rejected again. If you can bring the draft up to the required standard and it is accepted, the redirect at Surojit Chatterjee can be deleted to make way for the article. January (talk) 11:22, 27 July 2014 (UTC)

Hello January

I have sent an email to permissions-commons@wikimedia.org regarding the image https://en.wikipedia.org/wiki/Draft:Yuri_Goloubev#mediaviewer/File:Yuri_Goloubev_David_Forman.JPG which is in danger of deletion.

I attached the email from the photographer granting permission. I have sent the email to permissions several times. Previously I heard very promptly if permission was accepted but not this time and I do not want to week to pass and the image to be deleted. There may have been some confusion in that there were 2 versions of the same image that I uploaded. I asked for the one ending.jpeg to be deleted ( it was, very speedily) so there is now only one image.

Is there anything else I can do?

I've added {{OTRS pending}} to the file description page, which usually extends the time until deletion to about a month. According to c:Commons:OTRS/Noticeboard the current backlog for e-mail permissions is 7 days, if you haven't heard from them after this time you could enquire at that noticeboard to check whether they've received it and if there is any problem. You seem to be removing my notices (which I believe are fair) and bombarding me with SD tags. The file File:Sean Welsh PTFC.jpg is completely fine as, if you care to review other Thistle players, you will see that many of the photographs I upload to Wikipedia have been taken by myself. I also don't feel I should be blocked from editing as I have made many positive contributions. Andrew Henderson
I opened a thread at ANI when I saw you had yet again tried to change the date on the tagged file to 2015 so it will have to continue there, but I checked through your uploads and found several images which had been copied from other websites and claimed as your own work. The second version of File:Sean Welsh PTFC.jpg is the exact same photo, same resolution, that appeared [2] here in August 2013, several months before you uploaded it. It was taken with a Canon camera, and the uploads of yours that look genuine were taken with a Nikon camera. You have copied several other files and falsely claimed them as your own work. @Ikhtiar H: Assuming you mean File:Seth Rollins in August 2014.png, when you take a screenshot of a video the copyright belongs to whoever owned the copyright to the original video. File:D2Taylor2011.jpg so what can I do?

I have been trying my best to justify the addition of a photo for the article Ivy Taylor, an article about a significant person in politics, as she is the current Mayor of San Antonio. @Creed90952: Sorry but non-free images of living people are normally considered unacceptable fair use on Wikipedia (see WP:NFC#UUI). WP:NFCC#1 requires that "Non-free content is used only where no free equivalent is available, or could be created, that would serve the same encyclopedic purpose" (emphasis mine). For a living person, particularly an active public figure, it is possible for someone to create a free image of the person so a non-free image would be considered replaceable. Posting a photo onto a social media site does not make it public domain. You would need to provide evidence that the copyright holder has released it into the public domain or under a suitable free licence to be able to use it here. January (talk) 17:28, 4 September 2014 (UTC)

How do you post a simple photograph without violating the copyright policies?

To be able to use this image on Wikipedia we need the copyright holder to release the photo under a free licence, ie one that allows the image to be used/modified for any purpose including commercially. The copyright holder is normally the photographer unless the image is a work for hire. If you were given permission to use it only for Wikipedia with no licence specified, unfortunately this won't be sufficient so you would need to ask the copyright holder if they would be willing to release the image under a free licence. Page Creation

I was just wondering how to approach the administrators for page creation. I have added a request for page creation at https://en.wikipedia.org/wiki/Wikipedia:Requested_articles/Applied_arts_and_sciences#Schools.2C_colleges.2C_and_universities

I am made to understand that only admins can create a this page again as it was having the promotional content. Now the promotional content is removed and I want to have this page up and running with the basic content.

Could you please look into this and suggest the move forward.

Sorry for the late reply (I haven't logged in for a few days). I see you've had some advice from another user since you posted this and are working on a new draft. I will just add that it was noted before the article was deleted that it contained material copied from another website, it is not acceptable to copy material from copyrighted websites so you will need to ensure that new version of the article you are working on is written in your own words (see WP:COPYVIO and WP:Close paraphrasing for more information). Image permission

Hi there. You've marked the photo I uploaded of Dave Holmes for deletion. I'm not sure what more I can do to verify permission to publish. I produce Dave's podcast "International Waters"[1] It's a photo he had taken for promotional purposes and he says he's happy for it to be used here with the photographer credited. I can take a different photo of him when we record next week, but it seems a shame not to use the professional one taken for these purposes. If you have the copyright holder's permission to do so you could put a statement on the source website stating that the photo is licenced under the Creative Commons attribution 3.0 licence (the licence selected when the image was uploaded) or another licence from the list at Wikipedia:File copyright tags/Free licenses. Please be aware though before you do this that this will allow anyone, not just Wikipedia, to use or modify the image for any purpose including for commercial purposes (permission for Wikipedia use only is not sufficient), and the licence cannot later be revoked. @Mr colin anderson: Sorry but we don't accept the non-commercial/no derivatives version of the CC licence, these restrictions are not compatible with a free licence (please see [4] for background/explanation on why we don't accept these restrictions). User name change

Dear January

I acknowledge receipt of your further email about the user name Aztar Press. I am not sure if I've done it correctly, but have submitted a "request for name change" (from Aztar Press to JudyCroome) via the link that you provided in your email. I did not start a new user name as I was not sure how that would affect the current correspondence relating to copyright permission from University of Cape Town submitted this morning to the permission department under the old user name.

I trust that this meets your requirements (although I would appreciate your help in checking to see if I submitted the name change correctly.) I will watch this page to see if the name change has been approved.

Another question, relating to the apparent conflict of interest in editing - if I am not allowed to load this photo to the wiki article BERIC JOHN CROOME is there a way in which I can submit it to Wiki for approval and entry into that article by a non-related editor? As I do all my husband's social media, it would be a great help if there was a way I could submit this and future updates to a central editor at Wiki for review & inclusion, thus avoiding conflict of interest.

Looks like your username change has already been done. Regarding the article, certain edits are usually considered acceptable even for editors with a COI (see WP:COIADVICE) and adding a photo would in most cases be uncontroversial. Only autoconfirmed accounts (accounts with more than 10 edits) can upload files which is why you can't upload a new logo yet, but you can request this be uploaded for you at WP:Files for upload. However you will need to change your username before continuing to edit as Wikipedia's username policy does not permit using your company name as a username. Use of Non-free images

Hi, I have been reviewing non-free image use policy to try and ascertain to what extent images can be used with a suitable non-free use rationale. Wikipedia policy allows for non-free images of deceased individuals to be used in articles about them. If there is no article about them, can images of deceased individuals be used in other articles? Also, can non-free images be used in non-biographical articles. There doesn't seem to be anything specific in policy that covers this, so my assumption is that they can. What do you think? Can you please direct me to any examples that can shed some light on this area? Graemp (talk) 12:53, 13 September 2015 (UTC)

It's rare for a non-free image of a person to be accepted in any other article other than their own biography, the only examples that come to mind are articles about crimes which have non-free images of the perpetrators or victims (eg Moors Murders). The criteria that they would most likely fail on is WP:NFCC#8 (contextual significance). Unless the actual photograph or the person's appearance is being discussed in the text, or knowing what the person looked like is essential for the reader to understand the text it is unlikely to meet this criteria. Thanks. I had used a non-free portrait to accompany the biography of a candidate in a by-election where that candidate was in my opinion, insufficiently notable enough to warrant their own biographical article. This was the article. Southend West by-election, 1959. Another editor has now deleted the image for "fails NFCC#8". Would you agree that in this case, the image has contextual significance in the article and that as with the use of any portrait, it significantly increases readers' understanding of the article topic? Question about review

Hi January, I am new to wiki and I recently created my first page (https://en.wikipedia.org/wiki/Ajit_Johnson). There is a banner that says "This page is a new unreviewed article. This template should be removed once the page has been reviewed by someone other than its creator". I am not quite sure if I need to submit it somewhere to get it reviewed? Reason for deleting photo?

Why are you deleting the official photo from my appearance on Howard Stern that was requested 8 months ago by a known vandal to my page that caused my page to be protected the first time? @Taychatlc: The photo was deleted because we do not have permission from the copyright holders (presumably the Howard Stern show) to use it. The Flickr licence is not valid because the Flickr account does not belong to the copyright holder (this is known as licence laundering). In order to use it we would need the copyright holder to grant permission in accordance with WP:CONSENT (which would mean allowing commercial use and modification of the image.) @Dunesnibs: The TV programme you took it from is copyrighted. Capturing your own screenshot of it does not make it your own work and does not give you any copyright to it.
