I am editing pages to help insure that my company has a chance to appear ahead of those companies who are using my Registered Trademark "True Audio®" without permission. Yes, I have edited the TTA page (and others) to eliminate references to "True Audio®" which is my Registered Trademark (Serial No. 78711981). Several Wikipedia entries use this mark without permission and must be cleaned up or removed. Do you have a formal procedure for enforcing Trademarks/Copyright? You can immediately verify my ownership of this Trademark at the uspto.gov site. The mark has been in continuous use on my audio products since 1997, is on the principal trademark register, and is now legally indisputable. The mark True Audio® MUST NOT BE USED WITHOUT EXPRESS PERMISSION. Note that the Lanham Act (15 U.S.Code § 1114) provides severe penalties for Trademark Infringement.

Regarding the new page I created: If you feel you must remove the new True Audio® page I created so be it. But there is a LEGITIMATE company called True Audio® that your readers should be able to learn about...especially since Wikipedia has been complicit in infringing my Registered Trademark.

True Audio® is the Registered Trademark (78711981) of John L. Murphy, Andersonville, Tennessee. All rights reserved.

Please respond here no later than 14Aug14 tell me exactly how you propose to eliminate the infringing use of my Trademark at Wikipedia. Firstly, I would ask you not to make legal threats, and I would encorage you to withdraw this threat straight away. Secondly, if you have an issue with organisations using your mark, I suggest you take it up with them. Finally, if you have an issue, I suggest you contact the volenteer response team, who will be able to deal with this better, however constantly reverting my edits will only get you blocked for disruptive editing. --Mdann52talk to me! 13:49, 13 August 2014 (UTC)[reply]
Hi, I'm Nick and I'm an administrator here on Wikipedia, and at our sister site Wikimedia Commons. Mdann52 has asked me to speak with you and give you some guidance about your trademark issue.
Firstly, Wikipedia itself is not infringing on your trademark, as we are not using it to sell audio equipment or related services, and it is included within our project in the same way as trademarks from tens of thousands of other companies, from Microsoft to IBM, Coca-Cola to Kraft. We use trademarks under several legally protected avenues which protect the right to free speech and allow the fair use of otherwise copyright and trademark protected material. This means our use of your trademark does not, by law, infringe that trademark. It's often referred to as critical commentary or encyclopedic use in legislation and consumer guidance.
Secondly, this appears to be some sort of dispute to which Wikipedia is not actually a party - if you have issues about AMD using and/or infringing on the term TrueAudio, you must address them to AMD directly. We can only go on what trademarks and registered marks AMD use, unfortunately.

Hi Nick,

As the owner of various Registered Trademarks over three decades I have a little experience in prosecuting trademark issues.

Yes, Wikipedia uses many trademarks in accordance with the fair use policy. But just for one moment let's do a thought experiment and try to imaging what would happen if I created a new Wikipedia page where I described my new cola beverage "CocaCola" (no hyphen) in great detail...complete with logo art. You know how that would end. The Coca-Cola company would promptly eat you alive in a court room faceoff and you would have to delete the page after paying great big penalties to the Coca-Cola company.

I understand "fair use" and how it applies to news articles and such. But the AMD "True Audio®" page under discussion constitutes a "marketing brochure", it is not just an information article. As such, this particular page serves as marketing in support of interstate commerce and is subject to regulation under trademark law. So I disagree, I am of the opinion that Wikipedia IS, according to the law, infringing my Registered Trademark by hosting an AMD marketing page bearing my mark and images containing my mark. With this page Wikipedia is effectively serving as a marketing agency for AMD. You must remove my mark from this page immediately.

I have a legal obligation to defend my Trademark against unlawful infringement in order to preserve my rights to the Trademark. I see no reason why I should not affix my Registered Trademark notice on the offending pages to at least make readers aware of the improper usage. You should not revert these edits as long as this page persists.

As you have not yet indicated how Wikipedia will resolve this Trademark Infringement, I ask that you respond here no later than 14Aug14 with a plan for how you propose to eliminate the infringing use of my Trademark at Wikipedia on the AMD "True Audio®" page specifically.

John, just a friendly heads up but you may want to talk with your lawyer about your mark. Your registration indicates the first commercial use was 1994 but "Sounds True Audio" was around in 1992. True Audio codec was already in wide use before you registered so it might further complicate things for you. Either way, I wouldn't worry too much about wikipedia, it'll correct itself once AMD stops using the term so you really only need to worry about them.
